MAYOR LANE SUGGESTS IT Fine Is Provided for Failure to Sub. inlt Statement of Earnings and Financial Standing Each Quarter. Public service corporations will here after have to he more prompt in filing reports with the City Auditor If the Council at Its meeting tomorrow passes an ordinance that was recommended to It yesterday afternoon by the committee on Judiciary and elections. Under section P! of the city charter corporations holding franchises are Tequired to submit quar terly reports of their receipts, disburse ments and general financial standing. The proposed ordinance provides a pen alty for any violation of this require ment. For many months It has been obivious that an ordinance of this character would be necessary before various corporations in Portland would comply with the char ter rule. At the instigation of Mayor Lane requests for reports were sent out by Auditor Devlin many months ago. The response from most of the concerns afTeeted was discouraglngly tardy. Some of the corporations, in fact, have not sent in their reports up to the present time. Heavy Penalty Provided. The ordinance that U recommended for passage was introduced at the last meet ing of the Council. It provides as a penalty a fine of from J250 to J50), or Imprisonment of not more than six months, or both fine and imprisonment. Any franchise-holding corporation fail ing to keep full and correct books and to submit quarterly statements to the Auditor Is liable to the, penalty. The judiciary committee also took up the consideration of a communication from Mayor Lane, recommending the re vocation of the franchise of the Peoples Market Association to a block In South Portland. This property Is held by the association under stipulation - that It be used only for market purposes. It was charged by the Mayor, and admitted! yes terday by attorney fpr the association, that this rule is being violated. The two members of the Judiciary committee pres ent. Baker and Boothe. expressed them selves in favor of canceling the franchise, but postponed action until the next meet ing. Rent Is Merely Nominal. It developed that the assocation Is pay ing only 1100 for the property, and this was declared by Backer as ridiculously low. Frank Motter, attorney for the marketmen. urged that the enterprise had only lately been placed on a paying basis, and that the occupants had spent con . eiderable money for improvement. He ald that it would doubtless be only a shiTt timeuntll they could give the city much larger returns. The market, which is a public convenience, could not have been, carried on at all had not the fran chise been violated by using a portion of the space for store purposes. The sentiment of the committee favored allowing the present occupants to retain the property, but not under the present terms. The franchise will be revoked and a new agreement entered into if the Council sees fit. A special meeting of the Judiciary committee will be held tomor row morning at 10:30 o'clock, and in the meantime the committee will try to come to an understanding with the association. It has been suggested that after the fran chise Is revoked, a lease at a higher con sideration be given the marketmen for five years, the longest period that city property can be leased under the charter.
