ALSO WANT BACK SALARY Mayor Iane, Chief Grltzmacher and Executive Board Mad Defend ant In Action Begun In State Circuit Court. U O .Carpenter, J. F. Resing and Jo seph Day, former city detectives, have bought eult In the County Court to re cover their positions and to obtain sal aries to date and the cosu of the suit. The suit was tiled yesterday with County Cleric Fields. It alleges that Acting chief of Police Oritzmacher had no authority to discharge these detectives !rom the force, and that Mayor Lane and the members of the Executive Board were In error in not making specific charges galnst them. The Executive' Board is composed of the following m embers t Xtwmaa 3i Greene, C. A. Cogswell, John Montag, I T. Peery, Richard Wilson. R. L. Sabln, W. Q. McPherson, Max Fleischner and A. 3. Fattullo. On June 20, 1903, says the complaint, L. C. Hartman, Joseph Day, Frank J. Snow, J. F. Resing, A. G. Vaughn and G. Carpenter passed the examinations of the Civil Service Commission and were duly appointed to serve at a salary of J90 a month. On August 25. 1906, it says, the Chief of Police sent each of these detectives a copy of the following notice: Sir: By direction of the Mayor of Port land you are hereby notified that from and after this date your services as a detecUve are no longer required. The grounds for your dlsclarge are. Incompetency and inef ficiency, failure to comply with the rules and orders of the department, and failure to give satisfactory service. Tour longer con nection with the police department would be Incompatible with good service, and against the best Interests of the city. Res pectfully. (Signed.) C. GRITZMAHER, Chief of Police. The Chief of Police, the complaint con tinues, eierclfied Judicial authority, which was beyond his Jurisdiction. The com plaint also alleges that on August 31, 1906, the Executive Board adopted a resolution sustaining the charges against these de tectives, who were discharged, but that no epeclno charges were brought forward. In the resolution, according to the com plaint, the Executive Board says: "We have not held a formal trial nor heard the statements of the officers named, but we have waited in vain for nearly a year for even ordinary results. "Sine In the cases of the six detectives we are satisfied that the charges above specified are well founded and that the action of the Mayor and Acting Chief of Police Oritzmacher was and is Justified by the facts, and should be ratified, we are cf tie. eplaloa ihaX formal trial en our part would be a useless formality and a work of supererogation." A copy of this report. It Is alleged, was served upon each of the six detectives. The three detectives, filing suit base their complaint on the section of the char ter of the City of Portland which is said to provide that no employe of the classi fied civil service who shall have been ap pointed under the provisions of the civil service Jaw shall be removed or dis charged except for cause, upon written charges, and, no written charges having been made, they pray the court to grant an order directing the issuance of a .writ of review, and that upon such review the proceedings of the defendants be set aside and quashed. Ralph B. Moody appears as their attor ney. Mayor Iane, Chief of Police Gritz macher and members of the City Execu tive Board are named as defendants In the suit. SUES FOR. HIS COMMISSION Real Estate Broker Claims Fee for Selling Fourth-Street Property. Witnesses flatly contradicted each other yesterday In the trial of the suit of James Humphrey, a real estate broker, against Ziporah White. The suit is to recover a commission of 2660 and was on trial In the court of Circuit Judge Frazer. The property Involved in the suit con sists of lots 1 and 2, block 63, and are lo cated on Fourth street. Late In 1906, Mrs. White sold these two lots to Dr. E. H. Parker for $100,000. Humphrey alleges that he was the agent who brought to gether the buyer and seller. During the morning, session of the court Humphrey was placed on the stand, and testified that he had negotiated with Ben Blumauer. brother-in-law of Mrs. 3ffhlt or xa-sntlnallv. aa fistion for. ihe sale of the property. He also testified that Blumauer was her duly authorized agent in the matter! and that the time limit to the agreement giving Humphrey the agency for the property was several times extended before the sale was finally effected. Humphrey stated he was satis fied that In dealing with Mr. Blumauer he was In the same position as when dealing with Mrs. White. When Mr. Blumauer was called to the stand, he contradicted many of the state ments of Humphrey. He claimed not to have given Humphrey an option, said no arrangement was made in regard to com mission, and said he had only acted as agent for Mrs. White in the collecting of rents, and that his authority was lim ited. At the afternoon session, Mrs. White corroborated the testimony of Mr. Blu mauer. saying he acted only as her agent In collecting rents, and that he had no authority to give an option on her prop erty and did not do so. She stated she had not been anxious to sell, and until a short time before the sale of the prop erty to Dr. Parker did not state what she would take for it. At 3 the lawyers were through taking testimony and the court adjourned. Judge Frazer stating that he would announce Judgment before the end of the week. ARE YOU A CLUB MEMBER?
