Justice Wal demar Seton, who presides over the Bast Side Court, finds himself defendant In an action for garnishment In his own court, and yesterday morning was served with the papers In the case by Constable A. D. Keenan. It grew out of the lawsuit of Fred W. Goldapp against James A. Cut shall for possession of tho house at 695 East Main street, a forcible entry and de tainer case. Plaintiff had raised the rent to' JSO, which defendant refused to pay, claiming a verbal lease at 523 a month. Defendant paid to Justice Seton a $25 ten der. Yesterday morning the Justice decided the suit In favor of the plaintiff, where upon he undertook to garnishee the $25 in Justice Seton's hand, and served him with the papers. Justice Seton filed his answenln his own court to the effect that personally he had none of the property or money of defendant In his possession, but that defendant, F. "W. Goldapp, had In the hands of the Bast Side Justice Court 525. Bonds Go to Next Bidder. Auditor J. TV. Hanks and City Attorney S. H. Green, representing St. Johns, yesterday for warded the next lowest bidder for the 210,000 municipal bonds. In Chicago, a transcript of the proceedings in connec tion with these bonds, and also a copy of the city charter. The bonds were report ed unfavorably on by the attorney of Morris Bros. & Chrlstcnsen. who had in the highest bids, on the grounds that the-4 charter did not provide for bonds for pay ing debts or acquiring land for a City Hall. The Council hopes for "better re sults from the Chicago bidder. Troubles for St. Johns Grow. Now that the legal standing of Councilman C. X. Edwards, of the St. Johns Council la In question, until the matter can be set tled It Is feared that all business trans acted on which he may vote may have a cloud cast on it. Piatt & Piatt, of Port land, gave their opinion that he was no longer a legal member, as he was not a freeholder, but Councilman Shields sub mitted an extensive opinion from an at torney that he was still a legal member. City Attorney Green says he Is not a legal member under the charter. Says Cost Is Too Hioh. The committee appointed to collect from the Grand-avenue property-owners their half of the cost of erecting an elevated roadway between Stark and Oak, Is not making much prog ress. So far none of the money has been collected. One property-owner, who has CO feet fronting Grand avenue. Informed H. H. Newhall that a contractor had of fered to build his portion of the roadway for J200. First Presbyterian Church, corner Twelfth and Alder streets. Services to morrow at 10:30 A. M. and 7:30 P. M. Rev. A woman picked up a purso on a street yesterday afternoon, and handed It to Policeman Richards, of the crossing squad. He turned It over to Captain Moore. The funeral services of the late Mrs. Mary A. Keyes, who died July 20, were held yesterday aft ernoon at FJnley Chapel, the Rev. Van Walter, of the East Side Episcopal Church, officiating. Mrs. Keyes was a na tive of Portland, a daughter of Mrs. J. T. Baxter, of 514 East Oak street Her en tire life was passed In the city, where she had a large circle of friends. Mrs. Keyes was twice married, her first union being with Frank Yost By this marriage there were three children, all of whom are liv ingMrs. J. L. Kellar. of San Francisco, and Myrtle and Harry P- Yost of Port land. CUMMINGS RESIGNS Tires of Constant Wrangling in the Aflcta School District. C H. Cummings, chairman of tho board of directors of the Arleta School District No. 47, becoming tired of the wrangling In the district at the special school meet ing held Thursday night tendered his resignation in the midst of the meeting and vacated the chair, which was as sumed by Clerk Hugglns for the remain der of the evening. This meeting was called to provide for the erection of a supplementary building, lev a tax and transact general business. At a former meeting, 5750 had been appropriated for erection of this supplementary structure, but as Chairman Cummings had voted af firmatively to break the tie vote on the appropriation, the measure was considered illegal. All this was rescinded at the spe cial meeting Thursday night It was In the midst of the proceeding that Chairman Cummings became very indignant over the action of the meeting and the bicker ing, and resigned as a director. Clerk Hugglns then took the chair, when it was moved and carried that the directors be empowered to rent if possi ble, a suitable room, and furnish It, but build if such room could not be secured, and also to borrow money enough to meet the cost Yesterday the remaining mem bers of the School Board consulted with County School Superintendent Robertson, who decided there was a vacancy which must be filled. Hence last evening the Di rectors called another special meeting -for tho 1st of August to elect a Director, re ceive the report of the present board and consider a proposition to borrow money. WENT THERE TO BATHE Accident Takes Place on Sanvles' Island, and Victims Are Ada and Elnora. Payne, Aged 17 and 14 Respectively. Is a small stream a mile from their home on Sauvies' Island, Ada Pearl and Elnora Payne, aged 17 and 14 years, were drowned yesterday afternoon. and though friends worked for an hour over their bodies, no flicker of the vital spark of life appeared. The girls were the nieces of F. C Barnes, County Commissioner, and the daughters of J. M. Payne, a resident of Sauvies Island. Gilbert River, x tribu tary of Willamette Slough, runs near the Payne home, and yesterday afternoon. soon after dinner, the girls announced their Intention of bathing In the stream. which at this point has some current Not long afterward their clothes were found hanging on bushea. and a search was made. It was apparent from the position of the bodies that the girls had been trying to swim, and had gone be yond their depth. Tho older of the two could swim a few strokes, but apparently was the first to find herself In danger. The younger girl had bravely plunged In to rescue her tester, and -In turn had found herself unable to give aid or to help herself back to land. The bodies were about 30 yards apart and In six feet of water.
