N Says BUI to Relieve School Handling Funds Is Clumsy 111-Advised. and A. bill to relieve School Clerks throughout the state of the duty of 'keeping and handling: school funds and providing that County Treasurers shall keep all school funds and pay all claims against districts by warrant, which has been introduced in the State Senate, is strongly opposed by John M. Lewis, County Treasurer -of Multnomah County. There are about 60 school dis tricts in Multnomah County and if such a law is enacted Mr. Lewis says it will compel him to keep 60 different ac counts of school moneys, which is no small task, and the. bill allows him no compensation for doing the work which would .necessitate the employment of a deputy by him. He says the law would result In great inconvenience and not prove any better safeguard than the present law. In fact Mr. Lewis says If a County Treasurer should happen to default he might get away with the school moneys of all the districts, while if a School Clerk goes wrong only one district suffers. But Mr. Lewis says that School Clerks have been honest in the past and will prove so In the future, ns well as County Treasurers, and that a change in the existing statute is un desirable. DOCTOR IS SUED. Damages to Amount of $26,640 Asked for Alleged Malpractice. Suits for $26,640 damages for alleged malpractice have been tiled in the State Circuit Court against Dr. Etta Hill Schaauffer. George F, Hawley sues to recover $21. 640 on account of the death of his wife and baby. He sets forth in his complaint that in October, 1904, Dr. Schnauffer was called to attend his wife, Jennie Hawley. in a childbirth case. The child died when 36 days old and the mother died on No vember -24, 1004. Carelessness and un Eklllfulness. on the part of the attending physician are set forth as the cause of death in both instances. Hawley also avers that he employed another physician and paid out large fees In an effort to ave the life of his wife. C. A. Frascr, administrator of the es tate of his dauchter. Jennie Hawley. has also sued Dr. Schnauffer to recover $5000 on account of the death of his daughter. This is the statutory amount of damages allowed In such cases. Long & Sweek appear as attorneys in both suits. JURY ANSWERS BREYMAN. Testimony Was of His Own Accord, and Did Not Indict Him. A. H. Breyman and John Sommerville were not indicted for renting their prop erty (the I'arls house) for immoral pur poses on the involuntary testimony of Mr. Breyman. This statement is made by for mer members of the recent grand Jur'. F M. Johnson, A. C. Falrchild, John M. A Laue, Iarkln Russell, George H. Thomas, J. B. Quay and Lewis Van Vleet. They filed an affidavit to that effect yes terday in the State Circuit Court, In an swer to an affidavit by Mr. Breyman. The late grand Jurors affirm that when Brey man appeared before them he was duly sworn to tell the truth, and was then in formed by the foreman, F. M. Johnson, that he need not testify In answer to questions put by various members con cerning any matter that might criminate him. or that would In any way connect him with any crime committed. Any vol untary statements. It is alleged, he made of his own accord. REAL PROPERTY SELLS FIRST Amendment to Probate Laws Which Saves Personal Effects. A bill to amend the probate law so that In estate matters real property can be sold before all the personal property has been exhausted has been prepared by Judge Webster and the Legislature will be asked to pass it. Under the present law all personal property must be sold before the sale of any real estate can be made. Judge Webster thinks such a law is wrong and that they should provide that real property can be sold even where there is personal property remaining by an order of the Probate Court. The court will decide if the sale is advisable or not. The point in the case is this: Some times in an estate there is personal prop erty which it is very desirable to hold, ahd some real estate which is not a choice selection. It is considered better to sell off undesirable real property to pay off the Indebtedness of an estate than good personal property. Under the pres ent statute this cannot be accomplished. HOP CONTRACTS CAUSE SUITS Damages Asked of Growers Because They Failed to Deliver. Herman Uchtman yesterday commenced U.it ngalnst Thomas McNlsh in the State Circuit Court to record $2SS0 on account of the rcfupal of McNlsh to comply with a contract to sell 24,000 pounds or more of hops at 15 cents per pound, entered Into at Dayton, January 2L 1904. Uchtman has also sued William Cain j for $2S80 because of the failure on the ' part of Cain to keep a contract for the j sale of 14.0)0 pounds or more of hops at 25 cents per pound, entered Into at Day- j ton January 21. 1904. ) Asks Attorney's Fees. j Mary A. Acton, who wants a divorce I from Alteon Acton, yesterday filed a mo- j tion asking the court to order her hus- band to pay $150 to enable her to carry on the suit. Mrs. Acton says she is j wholly dependant upon the labor of two I sons and 1b keeping house for them and I five minor children. Her husband, she j alleges, earns $100 per month, has prop- j erty In Umatilla County valued at $2000 j and $600 In cash and Is able to pay the 1 $160 demanded into court. Buchanan Files Demurrer. Daniel E. Buchanan. Indicted for rent- l ing his property at the northeast corner of Fifth and Alder streets to the Portland Club for gambling purposes, yesterday, by his attorneys, Williams, Wood & Lin thlcum, filed a demurred to the Indict ment. The ground of the demurrer Is that the facts stated do not constitute a crime. Tho indictment was returned by the grand Jury on January 7. Files an Affidavit. Mallnda C Slider, who has sued Will iam H. Slider for a divorce, because of cruel treatment, yesterday filed an affl- j davit for publication of summons. In j which she recites that the defendant can not be served here for the reason that he ! Is now In McKeesport. Pa., his former J home. j Will Admitted to Probate. The estat'i of Ellas VIckers, deceased, was admitted to probate in the County Court yesterday. The property, consist ing of lot 5, block 64, Couch Addition, lot 7. block 7, West Portland and a small amount of personal property, is devised to Susan M. Nooning, a sister. Small be quests are made to nephews and nieces. Sues for Divorce. William L, Hunsaker has sued Mary A. Hunsaker in the State Circuit Court for a divorce because of Infidelity. He names one Billy as corespondent. Hunsaker also accuses his wife of cruel treatment. He says she has used abusive language to him and has frequently struck, beat and wounded him, and he was. compelled to leave her. They were married In Port land July 13, 1900, and have no children. Griggs Waives Examination. C K. Griggs, arrested for alleged frauds in connection with Alaska mining prop erties, appeared before United States Commiasloner McKee yesterday. He waived examination and gave a bond of $2000 for his appearance In the United States District Court. Division 2, of Alaska, at Nome. He is to appear there at the next term of court, and the formal charge to which he will answer will be that of obtaining money under false pretenses. Verdict for Cartwright. The United States jury In the case of LIHenthal Bros. vs. J. R. Cartwright, re turned a verdict yesterday In favor of the defendant. LIHenthal Bros, sought to recover $4500 on an alleged failure to complete a hop contract. Court Notes. Papers in a divorce suit filed by X. G. Venator against Margaret Venator. In Astoria, were served by the sheriff yes terday. Venator charges his wife with desertion. William Cohn. alias. Bill Booster, charged with stealing goods In a grocery store on Powell street several months ago, was tried before Judge Cleland and a Jury yesterday and was convicted of simple larceny. ' County officials say the statute allow ing only 10 per cent interest to purchasers of property at delinquent tax sales Is not enough, because brokers will not buy when restricted to such a low rate of Interest- At the 1903 tax sale, recently closed, the sales amounted to only $2000 out of a total of nearly $18,000. The old law permitted brokers to charge delin quents an unlimited rate of interest. Some say this law should be re-enacted, as it will encourage delinquent tax sales and compel people to pay taxes. "WILL DISCUSS MR. MANNING. Municipal League to Hold Secret Meeting Tonight. Tonight the Municipal League will hold b meeting in the Y. M. C. A. rooms to decide what they will do with District Attorney John Manning. It was at first Intended to ask Mr. Manning tot be pres ent at the meeting, but the District At torney has not been invited. Whether war will come as a result of the meeting Is a matter of conjecture. The leaguers have been very careful dur ing the past few days to make no state ments, but there is a sort of mystery about their actions that is taken as in dicative of the fact that startling things will occur. It appears that a part of the influential members are for war to the deadly end, while others ask for a "quiet campaign and another chance for the Dis trict Attorney. Least worried of all Is the District Attorney himself, who has made the statement that the league can do whatever it likes, that he has done nothing, said nothing and written noth ing he would fear to have the public informed about. It may be possible that the meeting tonight will not result in a decision, as many of the members are obliged to be absent in attendance at other meetings.
