Hulmau va L. Becker et al, continued. State ti James French, discharged as grand jury found ''not a true bill," on charge of committing an unnatural crime. In the case of Toraaiine Eudy vs. Thomas Chartnan, wherein the plain tiff sued on a promiiory note made in 1872 by J. M. Bacon, with the defendant as surety, the jury Monday rendered a sealed verdict which waa opened Tues day morning. The verdict was in favor of the defendant. JudgeMcBrlde Saturday morning gave decision In the celebrated case of H. C. Stevens vt.L. E. and Silas Wright, Reu ben Wright.Elicabeth Coatee.J LCrouse, Levi Stehtnan, A. E. Duff and James F. Nelson, being for nbe foreclosure of a mortgage that htoHxHin canceled on the record since Jnly 27, MM. The-note was given October 18, 1880, by L. E and Silas Wright to Thomas Charman, and subsequently sold to H. C. 8tevens. The note was secured by a mortgage on the Harrison Wrigbt donation land claim. After the sale cf the note to Stevens, Charman, by mistake, is it alleged, canceled the mortgage. Stevens was not aware that a mortgage had been given to secure his note until about a vear ago, and when he discov ered the fact he at once began suit to foreclose, not withstanding the nancella tion on the record. The defendants, other than L. E. and Silas Wright, are purchasers of portions of the land cov ered by the mortgage, and they relied upon the record showing the property to be from Inuumbances in order to get a clear title to the land. The precedent for this cae is one that went to the su preme court from Baker county a few years ago and a similar decision Is ren dered in this action, giving the plaintiff a decree of the foreclosure and ordering that the property be sold in an inverse order to that of its alienation to the de fendants; that is, first the land remain ing in the name of the defendants, then that of Reuben Wright, then that of Elieabeth Coates, then that of James F. NeiHon, and soon until the judgment of $965 shall be atis6ed. Wright's springs at Molallaare upon the property Included In this decree. Daisy Whitmore was granted a de- vorco from Charles Whitmore, on the ground of desertion . Dan Lyons took a decree against Will iam Hankins et al., for $375, to satisfy which the sale of lot 6 in block 109, Ore gon City, was ordered ; the Baptist col lege, at McMinnville, against J. W. Draper et al., for $1200, on lotl, block 29, Oregon City ; same against Charles Moehcke et al , for $585, on lots 11 and 12, block 8, Pleasant Hill addition to Oregon City; Abraham Lewis against Simon Gotlieb et al , $970. Aiken Sel ling A Co. took judgment by default for $150 against E. M. Hartman. The aale of W. T. Burney's property, known as Paradise, on the right bank of the Wil lamette between this city and Portland, to F. A. Toepleman, under foreclosure, for $5100, was confirmed. Ida Rinard was granted a divorce from L. H. Rinard. Decants of croeltv and (-failure to support, and allowed to resume her maiden name. GBAJfD JURY. On Friday two indictment were re ported against Henry Koehler of Barlow for selling liquors without a license and a bench warrant was issued . E. C. Hackett, former deputy sheriff and now principal of Canernah school, was on Fiiday last selected as a grand jury expert to examine the affairs of the county. A better selection could not have been made and that the work wil I be done thoroughly there is no doubt. An indictment was found against Wil liam Prettel for a crime against nature, and he was arrested and put in jail, in default of a bond in the inm of $1000. The charge against L. Shannon, of Canemab, for indecent exposure, the grand jury found not to be true and he was discharged. . 1 ;.j 01 hy lots 1 and 2 W F Kirk to Marv Dicken, n so nml an 1 u..
