Owing to the inabil ity of Earl McLaughlin to act upon laid board, it Is ordered that Frank W. Smith act in the place of said McLaughlin on said board and that the clerk notify said Smith of his appointment in said matter. Report of viewers on the James A. Smith road (private change) re ceived. Upon petition of board of viewers It is ordered that said board be allowed further time to. view out said road and that they make due report thereon at the January terra, 1909, to this court. Owing to the Inability of Earl Mclaughlin to act upon said board, It Is ordered that Frank W. Smith act in the place of Bald McLaughlin on said board and that the clerk notify said Smith of Ids appointment in the matter. The application of P. U. Doak for the position of janitor for new conrt house received. Application read and ordered filed for future consider ation. The application of II. H. Clow for janitor new court house was read and ordered filed for future consideration. The petition of R. M. Powell et al for right of way for the McKay Creek Tele phone Co, and to erect and maintain a telephone line on and along the county road from the corporate limite of Prine ville to the upper McKay school house ; said company to keep its line and poles on the easterly limits of aaid highway as much ai possible, and wherever necess ary to cross eaid road line and wires to be 20 feet above said roadway ; said line shall be so constructed, operated and maintained as not to in anywise inter fere with any telephone line now con structed on said road. Petition granted under above conditions. The resignation of J. W. Livingston as road supervisor of Kutcher precinct, district No. 23, was received and accept ed. R. C.
