The only opinion hauded down by the
supreme court this week was ia tne ct.e

pealed from Clatsop county, J. A. Fjkis
judge. This is a suit in which the plain
tiff respondent Cole seeks to restraiu
said city from enforcing a lien against
his property for improvenieutii oi wha
he contends is and always has been r.
county road; and which the municipal
ity maintains is a street within its cor
porate limits. The lower court found in
'favor of Cole.
This case is of general interest only
because tho city assumed jurisdiction
over tho former county road notwith
standing the ftct that there was noth
ing in its charter specif irally denoting
