The supreme court banded luwn ten opinions this morning. In the matter of the appeal of E. H. Amsden from Lake county on a motion to retax eosts the motion was allowed. The court in an opinion by Bean, justice, held that a defendant in a criminal case caiiuot re cover his eosts. "No provision is to be found in the-statute whereby a judg ment for costs or disbursements muj , be rendered in favor of a party acquit ted in a criminal action," says the op inion. In the case at bar tho defendant filed a cost bill containing an item of $18, for printing a brief. The item hav ing been allowed by tho county clerk the state moved to retax the costs. The motion to retax was allowed and the item of $18 was disallowed. Tho appeal of A. A. Auspland the Portland doctor found guilty of man slaughter in causing the death of a girl while performing a criminal operation was affirmed in an oprnion by Justice Burnett, and Ausplaiid must serve out his sentence. Fuel Adminis trator Garfield returned to Washington yesterday facing the fact that many cities had confiscated coal to supply freezing homes. "Save coal," was the cry at the fuel administration, as the situation's ser iousness sank in. "A shovel full must be considered as equivalent to a pound of sugar or a loaf of bread or half a pint of milk," said Director of Mines Manning. "One man's careless and wasteful use may mean an idle factory or a cold house for his neighbor." Commandeering of coal has been re ported from several Ohio cities. Relief measures ordered there will improve the Ohio situation, the fuel administration stated. , A meeting of anthracite dealers and operators with Garfield tomorrow is ex pected to work out steps for increasing production and co-operation in distribu tion. The 75 cents per ton additional being allowed independent anthracite operators will be attacked by the big railroad companies. Garfield was confronted with a 3.4 per cent decrease in bituminous produc tion for the week ended October 6, as compared with the preceding week.
