L DRAINAGE CAIOTJ STOPPED Judge Bingham Decides Water DisputeEach Party rays Own Costs Whether one man has the right to make ditches and furrows on his land so that surfaee water is drained oft onto the land of another is a question that has been up before Judge Bing ham in a case that arose in Linn county, but which will interest Marion farmers, and which he has decided in the affirmative. ,.The case is that of William and Minnie Schneider against M. Keefe, and they objected to Mr. Keef e plowing his land so that the surface water drained, onto their land. They sought to obtain an injunction restraining him from constructing the ditches. The plaintiff own 70" acres in the southwest portion ; of Donation land claim of Namrod Pierce in Linn county and the defendant owns 47.1 acres ef land from the same claim. The land of Keefe was higher than that of Schneid er's and by reason of natural flow the Surface water drained onto the lower property, 2Per y" , , .. . ... , For a ntimbet of years prior to the h:i5l V:i:r fear north to south, the water collecting in the dead furrows being drained into the ditch along the county road on the south by opening under the f enee. A depression in' the surface of the ' 1 . , nan .a . a . -A the defendant'! outkw Hetnef ana,"0'''8 "" " runs in' a westerly and northewesterly ter 1!""f 'Ti direction crossing the boundary line between plaintiff's land and that of the defendant about 250 feet north &X&VrM SSaZT followed by the water in its flow, is (leendanfS laud the watershed com mences obout 150 feet east of where the depression crosses defendant's lands about 165 feet north of the low est point in the depression. On the south the watershed line is about the same distance of the center of the depression. Ploying the land from north to south throwing a furrow next the fence, caused a slight embandment to be formed along the line, but this was not so low but that at the lowest point the water would over flow and find its way westward over the plaintiff's land, and finally find an outlet to the west. At the lowest point an outlet through this embankment ex isted until about the year 1915, at which time it was filled up with rails and the dirt embankment for a short distance was made higher, preventing a dramace to tnc westward over plaintiff's lands, except after heavy rainfalls, which acts of the plaintiff precipitated this suit. In the year 1915 Keefe changed his plowing from north to south to east and west, making his drainage by shallow, open ditches towards the low est point in the dividing line. Schneid er then blocked the outlet and in creased the embankment preventing the water at low stages from draining off. Keefe commenced an action at law to recover damages and to have the embankment abated as a. nuisance. Schneider then filed a cross bill in equity to have Keefe enjoined from constructing and maintaining a system of ditches as dead furrows so as to cause the surface water to be drained down to his land. It has been the enstom of both Keefe and Schneider to plow without fererence to this depression, and- after the lands are seeded to run a surface furrow following nearly the center line of the depression leading the flowagc westward, excepting when Keefe 's lands were plowed from north to south, when usually the water was led by means of the dead furrows towards the county road ditch. The general slope is toward the west, but it is apparent that during a heavy rainfall this depression, aided by fur rows, is not sufficient, to carry off the accumulated water with anv dpgree of rapidity, but only by a slow process of drainage. JULY 14. 1917. water against the land of Schneider in any greater quantities- than would be discharged had the furrows and ditches not been constructed, and outlet not have been provided into the ditch along the road. The water which ac cumulated on Keefe 's land was water from rainfalls and melting snows, and not water from springs. Schneider obstructed the natural flownge of the water by enlarging the embankment along their line in the year 1915 with the Intention of pro venting such waters finding an outlet across their premises and confining them to Keefe 's lauds; The Svhriciders havl! not been injured Or damaged by the percolating of such Impeded water on Keefe 's land, and Only slight in jury has resulted to Keefe 's lands or his crops by reason of the embank ment, and such slight injury might have beeu wholly avoided by drainage t6 the county rodd, which was practic able aud could have been done at small expense. . Keefe held that in the civil law al between the owners of adiacent lands "the lower 'proprietor is bound to receive the sur- naturally flow from w above, , do thing! to prevent such flew which will cast it back upon the laid above." Judge Bingham here quotes Smurr on "Farm Drainage " who toys: "How ever, in case the conformation of the e to tno sunaco- one tract to the other a fixed and determined course. so as uniformly to discharge it upon rixeo arm a surface channel or watercouse with in the meaning of the rule of law above stated." Judge Bingham says that if the above is a eorreet statement of tbc law then the sag or depression would be a watercourse, for it is nnuisputablo that unobstructed the water would flow westward across the land of the plain tiff and find an outlet at their west line over and across lands of an ad joining proprietor, and finally to a flowing stream. Judge Bingham says that Keefe 's legal right having been interfered with he is entitled to recover nominal dam ages and is awarded one dollar. The fact that either rty might have util ized the drain along the north side ot the county road with but slight ex pense, and neither having exercised any degree of toleration towards the other, each will be required to pay his own costs and disbursements.
