Officials Not Liable An important easo for the city of Portland was that brought by Victoria I. Colby against tne city of Portland. Mayor Albee, Coinmisioners Bigelow, Brewster, Dieck, Daly and City En gineer Dnter for damages for injuries received from an accident resulting from a defective sidewalk. The plain tiff caught her foot in a defective side walk at Kant 32 street and Salmon and was injured. She brought suit in Judge Kavanaugh's court and received a judg-' nient of $0350 against the city commis sioners. Ah to the city itself, Judge Jav anaugk allowed a non-suit. The case is reversed by Judge McBride and re manded for a new trial. Justice Moore wrote a dissenting opinion. It was brought out in the decision that if the city inspector did not do his duty in inspecting the walks, then tho city of Portland was liable, in spite of a charter amendment exempting the city from liability. If the commission ers did their duty regarding tho matter, then1 the judgment does not fall on them but on the city itself. Opinions in two minor Marion coun ty cases are handed down. Jt was found neces sary to transfer at this time the sum of ten thousand dollars from the im provement bond interest fund so that the city would not default in the pay ment of large amounts of interest now uue. it was declared tins action was necessity on account of the precarious financial condition in which tho city now rinds itself. Noma, receiver for the Hubbard building, was received asking tlihl the action of the council retusing the request to build a stair way on High street to tho basement be reconsidered as the city health officer , demned tho basement as unsani tary and requires ventilation to be established. Mr- Norris stated he wished to build the stairway instead of ventilators on account of the fact that they would be used as cuspidors bv (the public When it came to a vote the motion to reconsider was lost. K. L. Stiff & Son aslted the council for permission to build a corrugated iron extension to their building on Court street but the council refused permission as tho erection of such a structure would be contrary to the provisirMs of the fire ordinance. The petition was referred to tho fire and water committee. In response to a letter from the Polk county court asking that the city of Salem pay one-third of the cost of keeping a watchman on the old bridge and also the upkeep,' tho council voted authority to draw a warrant for one third of tho expense and send it to the Polk county people. The sum of 100 was turned over to tho playground board as due from the playground fund. It was reported that tho costs in the suit of John Albert against the city of Salem nmountod to $08.50, in that of Watson against the city $25, th-3 case of ('arson and Fry $48.33 and the case of Lord $19.
