Frank ant! Cliff .Smith, who were found guilty of maintaining n public nuisance at Inde pendence hy a jury in the circuit court Tuesday night, were each fined ifc'-MO h Judge II. H. Belt, Friday afternoon. This was the second trial of the case, the first one resulting in a hung jury. The attorneys for the defense have not yet stated whether the ease will be ap pealed. . Hopbrook Case Non-Suited. The case of S. A. Holbrook against Andrew Nelson was non-suited in the circuit court Thursday afternoon bv Judge IL H. Belt. The case was insti tuted by Holbrook to recover damages to a horse and buggy driven by thr plaintiff and run down by the defen dant's son, Harry Nelson, in an auto mobile owned by Andrew Nelsnii. Judge Belt sustained the motion for a non suit on the ground that Andrew Ne' son was not liable for the actions of a minor son. evidence having been pro duced that the boy trns using the ma chine without the consent of the fath er. The accident occurred on the Independence-Monmouth road just outside of Independence ou the evening of Oc tober 1, 1915. In the suit brought by Mrs. F. P Pyle, of Monmouth, against Sheriff J W. Orr to recover an automobile which the sheriff had secured from her on a writ of attachment from the circuit court, the jury returned a verdict ir favor of the defendant. Mrs. Pyle sought to recover the car and 73 for damages claimed to have been done her business by being deprived the use of the machine.
