The check was sigurd by Walter I
Tooze, Jr., of Dallas, and vuu mad
payable to Max Oehlhar, ns county
clerk. It was for tffiil and was in pay
ment of the filing fee in the thirteen
uidow's tension cases in which alterna
tive writs of mandamus were filed re
cently requiring the county court to
come into court and show cause why the '
uidow's pensions were not paid. It K
reported at the county clerk's office;
that Attorney Tooze wished to with-
draw the cases but .is they were filet' i
they could not be withdrawn without ;
an older from the court as the writs j
were signed by the rrrcuit judge.
When Mr. Tooze asked for the return
of the fee he was informed that the
fee was payable when the writs were
filed and could not be paid back as the I
filing had alrendv been completed. II
is evident that Ml'. Tooze stopped pay
ment on the check nt tho Dallas 'i
tional bank, of Dallas, and when t'
check reached that bank through
clearing house pnyinont was refused.
The protest fees were .t'i and as Mr.
Oehlhar 's personal guarantee goes with
the cheek to the buiiK when he accepts
it in lien of gold coin ho was obliged
to repay the county treasurer this
morning with a personal cheek. Mr.
(iehlhar states, however, that unless
the check is made good, lie will abide
strictly by the letter of the law and
refuse to accept any checks for filing
fees at his office from any attorneys in
the state, county or city, and tlmt
the future his terms will be "strictly
cash."

today, and was hardly interrupted all
day was again ascribed, not to outside
purchases but to the operations of pro
fessioinils. The movement was not accompanied
