the senate today by Wende, of Yakima,
and it governs the use of all waters ii

The Tumor Situation.
To the Kditor of the Cupltal Journal:
We of the city council of Turner, Ore
gon are glad to see that the little piece
published in the I'Vuni a short time
ago entitled "A Turner Knocker's
Prayer" brought -forth one of tho
knockers, who evidently was jealous
of the writer.
(Hut) we pity this snmc person in
his weakness, believing that he is only
tho feeble tool of tho persons who
wrote his answer for him. To show
Mr. Eurl's utter hopelessness ns a
business man or progressive citizen of
the community, we give the following:
Soino time ago a good roads meeting
was held in Turner for the purpose of
urging tho completion of the muendnm
road from Turner to Saleiii. During
the meeting Mr. Earl made ono of his
characteristic, non-progressive speeches
in which ha made tho nssertion that
if tho road was completed his business
would all go to Salem.
To show tho falseness of the so-called
answer signed by , Mr. Karl, we will
givo the real facts concerning the
recent city election.
To begin with, the issue wns between
those who favored a municipal gravity
water system, to be installed as soon
as practicable and to conform with
Ihe plans and specification made by
Mr. Staiinard of Portland, ni) engineer
of high repute; and against them, was
a fusion ticket composed of those who
wanted no water system, thoso who
selfishly wanted to own the water
system, and those whom you always'
find in a city or town no matter howj
large, who know- more law and en-
gineering than men who have made,
fhese professions a life long study.;
(This particular (dick wanted to delay I
the work by suggesting other ways,
which would have rosutled in nothing,
being done.) I
Needless to say the election was bit
terly contested. Knowing this the!
council made every effort to comply
with the law, so no trouble could be
brought up afterwards. Kach side was;
represented by judges and clerks onj
tho election board and when the votes
were counted at least a half doy.en
persons checked off the ballots as they'
were counted and in every case getting1
the same totals as the darks, thus
eliminating any possible error by the,
clerks. j
The results showed that the two old
coiincilinen were re-eloctel by cotn-t
fortable majorities and that Mayor1
Hooth whom the main fight had been
centered upon by the opposition, wasj
re-elected by two votes.
The election of Mr. Hooth has been!
contested by M. A. Nicely who has
been on several occasions very inti-j
mate with 11. A. Thiessen, the oily
recorder. " j
n view of the above and the follow
ing facts: that the city recorder and
his associates were bitterly opposed to!
Mr. Hooth; that he received the bal-
lots, broko open the seal ami doliverci
an unknown number to the election'
board; that he did not furnish n
separate reeopliclc for the tally sheets
and poll books, making it necessary ,
to enclose thein in tho ballot lu'x;i
that he had possession of the ballot
box containing tho ballots cast, im
mediately after the election; that it
would of been an easy mutter for this
ballot box, which was kept in an un
safe place, to have been tampered
with; that ho was very willing to open
the ballot box, when .ho thought the
council intended to recount the ballots,
instead of checking over the necessary
tally sheet uml poll book; that on re
fusal of the city council to recount the
ballots, he flatly refused to open the
ballot box so the necessary tally
shoot and poll book could be taken out
in the preseneo of the election board,
and the city council who were called
by the recorder to canvass the election.
Knowing that any unprejudiced per
son can verify these and other facts
without any trouble, we have tried to
got the motive of the contest thorough
ly gone into before tho recount is
ninde.
However, believing that fight is
bonl to dominate in Ihe end, W8
patiently await that result.
