Judge Wol verton in federal cDnrt yeiterday fixed at 100,000 the bond of the Southern Pacific railroad company in its appeal from the decree of the same judge in declaring forfeited to the government 2.300,000 acres of land in Oregon and California. The amount of bond was placed at the recommendation of B. D. Townsend, special assistant to the at torney general, who investigated charge that the railroad was not com plying with the terms of the govern ment land grant and instituted suit which resulted last April in Judge Wol verton's order that the land reverts to the Tinted States. Tho standing of numerous settlers on this vast tract is involved in the liti gation, many having taken claims on the understanding that when the rever sion took place they would have earned rights to prove up on homesteads. This view is not held by Lewis Sharp, of the local lnnd office, who declares the 'land must be formally thrown open by congressional enactment before settlers mav establish anv claim whatever.
