bound over to await the action of the
grand jury yesterday afternoon by Jus
tico of tho Peace Webster. Tho couple
worn arrested Inst Monday on the
chargo of unlawfully residing together
at s house on Thirteenth and Mill
streets. Both pleaded not guilty, and
tho court placed Mrs. Rue bond at "0,
and set Briggs' bond at 750. The lat
ter, failing to give ' tho necessary
bonds, was turned over to Sheriff Esch,
who locked him up.

their homo in Salom. Mr. Johnson is
tho son of Mr. and Mrs, C. L. Johnson,

Whether it is lawful for the owner of
a tract of land to fish with a gill net
in waters on his proimses or bordering

today by a Portland

A complaint was filed iu the circuit
court this morning by Maggie C. Bartch
against Geo. E. Quiggle et al., in which
the plaintiff is seeking to recover $3,
000 alleged to be due on a promissory
note given by the defendants.
Assistant Attorney-General DeLong
today held that tho new medical law
will not permit a student to take an ex
amination in a few subjects at a certain
time and later take tho balance The
assistant Attorney-general thinks the
new law docs not contemplate that an
examination can be strung along over
several dates. The students had Borne
how gotten the idea that the new law
mado it possible to take tho examina
tion on several different dates, if the
applicant cared so to do.
Tho prison and asylum board today
locided to authorize the head of the in
stitutions to proceed with the purchaso

Governor West today sent a telegram
to Secrctnry of State Bryan, now in

right back to Washington.

A letter for a printer named McCaus-
land has been received at The Capital
Journal, and is held awaiting his call.
DIED.
FREELAND. At the Salem hospital,
Wednesday, April 30, 1913, Foster
Freeland.
Tho doceased was five years old and
was brought to the hospital from In
dependence. His death was due to
blood poisoning.
BROCK. At the residence, Nineteenth
and Kansas - avenue, Wednesday,
April 30, 1913, CasBius Seaman Brock,
aged 67 years.
He was born in Holmes county, Ohio,
and came to Oregon in 1890. Mr. Brock
leaves, besides his wife, two sons, Ar
thur, of this city, and Clyde, who is en
gaged in banking in Hoppner, Oregon.
Tho latter was notified of his fathor's
death today and will arrive here tonight
or tomorrow. Funeral announcement
later.
Notice to Property Owners.
The common council desires to call
the attention of all property owners
to tho provision of ordinance No. 527,
relating to the laying of wator and
gas mains nnd service pipos, section 2
of said ordinance provides: "That all
mains used in the city of Salem, Ore
gon, for conveying wator or gas or for
other purposes along streots which are
permanently improved or to be perma
nently improved shall immediately be
for such improvement is mado, be laid
in such streets in a permanent man
ner." Soction 3 provides: "All service
pipes attached to mains shall not be less
than one inch internal diameter and all
pipes of loss diameter shall be removed
and immediately replaced with pipes
in accordance with the provisions of
this ordinance, and the same shall also
bo provided with curb cock and iron
shut-off box and cover and shall be
placed sixteen (16) inches inside of
the curb line; provided, however, that
this section shall not bo enforced on
streets not having permanent improve
ment." The council urges all property own
ers owning property upon streets pro
posed to be improved in 1913 to imme
diately attend to the proper installa
tion of water, gas and sewor pipos
serving their property, whether the
property has buildings thereon or may
bo vacant. This co-operation upon the
part of tho property owners is neces
Bary to a prompt and satisfactory com
pletion of the pavement projects under
way at the. present time.

prove Union street from the east line
of Wator strcot to the west line of
Twelfth stroot, in the city' of Salem,
Oregon, with one-course, six-inch
crushed gravol cement concrete pave
ment at the expense of the abutting
property within the said limiU in ac
cordance with tho plans and specifica
tions for said street improvement, as
heretofore adopted by the common
council of said city and on file in the
office of the city recorder, which arc
hereby referred to for a detailed de
scription of said improvement and
made part of this notice by such rof
erenco. Written remonstrance against the
aid proposed pavement may be made
at any time within ten (19) days from
the final publication of this notice in
the manner provided by the city char
ter. This notice is published for ten
(10) days by order of the common
council, the date of the first publi
cation bolng the 234 day of April,
