A few days ago a Salem morning pa ler printed that the attorney general had furnished an opinion stating that the raising of the city attorney's salary vas legal and thai the matter was set tled. I'lidouhtcilly it was settled so far as the morning paper inul some mem bers of tho council wore concerned, but it was far from being settled so far as the pcopl i of Salem the taxpayers who put up the money aro concerned. Con sequently, the Capital Journal has tak en it upon itself to get an opinion from ihe attorney general as to whether low ering the salary of the city attorney would not be just as legal as raising it. Attorney General Crawford states that it wiih absolutely legal for the council to have raised the city attorney's sal ary ami in this the morning paper was correct, but as the morning paper does rot give all the news like the Capital Journal does, it now becomes the Capi tal Journal's duty to inform the pub ic that Attorney General Crawford not only stated to tho representative of the Capital Journal that it was also legal for the council to lower the city attor ney's salary, but when requested by the Journal man to do so, also specified tho legal proceed li re for the rounuil to follow. " If a municipal charter provides, and it is not contrary to statute, for the raising of a city official's salary, whether it be that of the city attorney, or any other qualified official in the regular employ of the city, by introduc ing a bill for an ordinance, iu my opin ion such increased salary may be re duced through the sumo channels with the same degree of legality," said At torney flonornl Crawford yesterday in explaining tho process by which such acts aro governed by municipal corpor ations. "It is a matter of discretion on tho part of the city council or com missioners or the people at large to either raise or lower a city officials 's salary whether or not the official is al ready qualified or unqualified inunedi I'tely following his election. However,' while it is customary universally to fix the salary of any public official prior to his appointment or election to office, 1 do not believe Hint it is adverse to rules or law to re-arrange the wage sys tem by either lowering or raising sal aries after an elective or appointive of fice has been filled." Is Simple Method. It is but a simple matter now for the city council to draft a bill for an ordi nance reducing the city attorney's sal ary, should the members feel so inclin ed, as thero is no question of doubt hut that such an election would bo strictly in accordnnco with tho provisions of city charter. The passage of an ordi- r.anee reducing tho city attorney's sal ary would necessarily repeal tho bill passed raising the salary $300. Thero aro a few members of tho city council who nre perfectly willing Hint the city attorney's salary should bo lowered in the event a bill for Biich an notion can bo drawn up and passed in accordance with the city charter. The question of doubt arising out of tho manipulation of tho salary of tho city attorney is Hint in view of the fact the incumbent of tho offico was already serving when the council raised his pay the net wus possibly In violation of the city election provisions. According to the attorney i;eneral, the council acted legally and can act equally legally by repealing the ordinance and reduc ing the salury, The affairs of Rnlein's legal depart ment have been the source of much worry and discussion for years. It Is contended by some that unless a grenter salary is offered by the city, the offico will not be filled by a thoroughly com petent city attorney, Former city at torneys refused to accept another term in tho offico on account of tho salary being too small, but not one offered to tnko any action toward securing a raise. Attorney Grant Corby refused to accept the position a second time while Attorney Keyes declnred the salary was too low when he was in the office. With these facts freely circulated prior to the election of the new council men and with every candidate for the city attorney office familiar with the duties and compensation provided for the department, there was no occasion, it is said, for any lawyer to accept the office under the former salary unless he so desired. For this reason, it is a mat ter of much speculation why tho pres ent city attorney became a candidate, nnd nfter his election bv tho council, became evidently dissatisfied with the salary fixed by ordinance ami prepared a bill for an ordinance adding 3H0 more to It.
