Thus It Is made to appear that the harm Is to the pub lic and not to the court. J he decisions of all the courts which bold to this view show that this belief exists as to severe criticisms whether merited or not. Hut If a court could be Influenced, or If the peoplo should or could bo led to fear that the court cemld be In fluenced by criticism, whether merited or unmerited, why should they like wise notfear that the court would In like manner bo Influenced by great praise? Suppose, for Instance, a lower court should render a decision In an Im portant case, and that tho Judge so rendering this decision should be se verely criticised while motion for a new trial was pending. The crltlet In Biich case would be guilty of contempt of such court, on the theory that such criticism might tend to Influence or to Intimidate the judge Into granting such new trial. Hut suppose, Instead of severe crit icism, there should be strong and ful some praise. Would nut such praise be Just as likely to lnlluenee the judge to refuse to grant a new trial, as the crltledsm was to Influence him to grant tho motion? And would not then, the person who praises, be just as guilty of contecpt as he who criticised? It Boenis so to us. Yet, In all the boeiks and In all the decisions which we have read, and to which our at torneys have called our nttentlon, there Is no record of a single Inst mire wherein a case of contempt has been prosecuted wherein the court was praised not one. Can It bo regarded as possible that nt no tlmo In the entire history of American or Kngllsh Jurisprudence, no person or ne newspaper ever praised a oaurt for lis decision? It does not seem likely1.
