Of the 15 bids received, Welch & Wright, cf Portland, proved to be the lowest bona fide .bidders. At the meeting Tuesday W. D. Pugh sent In a commu nication asking thut Ms bid be re duced In the amount of $2644, which would have made his bid the lowest, and In view of which the board was Inclined ' to award the contract, but later Mr. Pugh wlthirew his bid. and this left Welch & n right the lo.vc.st bidders. Welch & Wright have Just recently completed a large school building it Vale, Oregon. The opinion was writ ten by Chief Justice Kakln. In the lower court, Judge William Galloway rendered a decree In favor of the plaintiff, enjoining the city from, as serting a' lien upon the property In question. The court held that the warrant for the collection of a street aHffBS- ment by the terms of Section 38 of the charter, Bhall have the force and effect of an execution against real property, and shall be executed In like manner, except as In the char acter specially provwid, and there fore It may be enforced even though Hie aitBewmmt Is not entered In the lien docket The MseHsmont having been fopnd to be regular and valid, the plaintiff Is not entitled to have It cancelled or decreed yold, the court holds.
