210 Claims Involved.
The case grew out of the filing of
applications of 210 entrymen on Boise
Basin, Crooked River and Six-Four
lands in Idaho in 1901-02. The defend
ants were the Barber Lumber com
pany, James T. Barber, Sumner G.
Moon, William Sweet, John Klncald,
Louis M. Prltchard, Patrick H. Downs,
Albert E. Palmer and Horace S. Rand.
They were accused of having con
spired with ex-Governor Steunenberg,
of Idaho, John H. Wells and others to
defraud the government.
The lower court dismissed the bill
on the ground that there was insuf
ficient evidence to connect the defend
ants with the alleged conspiracy. .

Dr. Brewer is building a 10-room
dwelling on Thirteenth street, adjoin
ing his residence, which is one of the
best In that locality. When completed
It will be occupied by H. H. Brians,
manager of the Brewer Drug com
pany.
Dr. Brewer Is very much disappoint
ed to see the big Bewer digger tear
ing up tho pavement, but there does
not seem to be any way out of the dif
ficulty. The property owners along
this street were In favor of construct
ing the sewer with In the curb line,
and, after considerable delay and a
number of meetings of the sewer com.
mlttee with the contractors, the Jahn
Construction company, It was doter-
mlned to lay the sewer In the street,
whore It was originally planned, .
After the sewer Is laid It will require
at least one year for the trench to set
tle to such an extent that the pave
ment can be replaced with any degree
of certainty that It will be perma
nent It Is certainly too bad that this
part of the pavement on Thirteenth
street could not have been deferred
until the sewer was laid.

J. u. LUerhard, who died January
26, at the home of .his daughter, Mrs.
Henry Austin, In Newberg, was born
near Bucyrus, Ohio, November 25,
1832. When he was four years old
his parents moved to St. Joseph coun-
Mlchlgan, where he grew to man
hood on a farm. When 22 i'gars of
age, and, with limited means, he
started for California by way of Pan
ama. Landing there, he eneaeed In
mining and farming m the Eldorado
district for five years. In the fall of
1859 he started for Oregon, where he
stayed, at Buttevllle, until the spring
of 1802, when he-Btarted for Lewlston,
Idaho, where he engaged In mining
and packing. Returning from the
eastern part of the state, he located on
farm near Champoeg, where he re
sided until the fall of 1911.
In January, 1868, Mr. Eberhard was
united In marriage to Miss Louise
Jones, of Champoeg, who died Novem
ber 27, 1896. Six children were born
to them, three of whom survive: Mm.
Barbara Austin and John P. Eber
hard, of Newberg, and G. A. Eberhard,
of Grants Pass. .
