JuBtlce Gerard, of the supreme Court, appoint ed by Governor DIx, to probe Brandt's charges that he was "railroaded" to Sing Sing, announced that the state constitution prohibited him from In vestigating the case. Justice Gerard said lie could do no work not In direct connection with his Judicial duties. Pending further In quiry, the Investigation will be halted. Another investigator, in all probabili ty will be appointed. Five years ago Brandt was Ben fenced to 30 years' Imprisonment. He was convicted of burglarizing the Schl(f mansion.
