Morse, the convicted New York banker, would be removed at once from the United States prison at Atlanta, Ga, to the government hospital at Hot Springs, Va., for treatment, was made this afternoon. He will tell the audience how he retains his youthful condition at his age, and will demonstrate the fountain of youth. o SELECT THE STUDENT'S HEAD GEAR The Willamette student body held its regular monthly meeting this morning after chapel. The commit tee which was appointed to select an official hat to be submitted to the stu dent body at this meeting reported that, after careful consideration, they had chosen hats of the following de scription for the college students, a soft, black felt hat with a cardinal and old gold band, and for the preps a similar one of white. After some dis cussion the report of the committee was adopted. On account of the ab sence In the executive ifimmittee, made by the absence of Wilfred Booth, who has left school, a new committee man was elected, and Eric Bolt re ceived a unanimous vote. It was voted that the 22d of February should be made a big day on the W. V. campus, arrangements to be made later. Defendant answered, denying the allegations of the com plaint, and by cross-complaint claimed a divorce from plaintiff: (1) On the ground of adultery with one Monroe Purvine. (2) On the ground of cruel and inhuman treatment The court denied plaintiffs prayer for a divorce and decreed one to defendant upon the second ground set up in the cross-complaint, Dut gae me custody of the minor child to plain tiff. The findings material to this ap peal are as follows: "II. That plaintiff did not commit adultery with Monroe Purvine at his house in Polk, county, Oregon, dp tween the 27th day of December, 1909, and the 8th day of April, 191, or at any other time.' III. That the defendant treated nlaintift in a kind and affectionate manner during all their married life but the plaintiff treated defendant in a cruel and inhuman manner and in a cold and indifferent manner and became of a quarrelsome and scold ing disposition and frequently com plained and quarreled with defen dant about matters of no moment or importance and associated with on Monroe Purvine a"d allowed said Purvine to nav attention to her against the will and without the con sent of the defendant, and plaintiff expressed by words and actions her dislike of the defendant and allowed said Purvine to treat her In the most affeetionate manner and to embrace her and kiss her and that plaintiff told defendant that she thought more of said Purvine than she did of de fendant; and that the defendant at tempted to Induce plaintiff to cease her attentions to and associations with the said Purvine but the plain tiff refused so to do and In the hear ing of defendant, plaintiff asked the said Purvine if he would wait for her one year; and that said treatment of the defendant, by the plaintiff wns cruel and Inhuman and caused de fendant great mental and physical suffering and anguish and rendered defendant's life burdensome so that defendant could not endure said treatment by the plaintiff any lon; er." Phone 114 COURT DECISIONS B;Porttr ol Ue iu. in her conduct with said Purvine, plaintiff is not of a bad or Immoral character, but Is of a good and mor- ( al character and Is a proper person and competent and qualinea to nae , the care, custody and control oi saiu minor child, Lucille Matthews, and plaintiff has a good home with hr mother, Mrs. Gilmore, at St. Johns in the county of Multnomah, Oregon, where she is able to care for, main tain and educate the said minor child in the manner befitting Its and her station in life." Defendant appeals from that por tion of the decree giving the custody of the child to plaintiff. The evidence was not brought up, the defendant relying wholly upon the transcript to reverse the decree. McBride, J. Thre is no inflexible rule which controls the discretion of the court in provicMng for the cus tody of a minor child in cases of this character. Sub. 1, Sec. 513 L. O. L., provides that the court shall have power to further decree "for the fu ture care and custody at the minor children of the marriage, as It may deem Just and proper, having due re gard to the age and sex of such children, and unless otherwise mani festly improper, giving the preference to the party not in fault." There have been few appeals to this court from adjudications ln such cases. Three are cited by counsel for appellant and these we will now consider. In Jackson v. Jackson, S Or. 402, the supreme court bad the testimony before it, upon which It decided that the mother was not a woman of good, moral character and that the father was as suitable person to have the custody of the child. In this case the court below had given the cus tody of the infant to the maternal grandfather, and not. to the mother. In respect to this part of the decree the court say: "This, however, is vir tually placing It under her controt, as she also resides with him. As be tween the father and grandfather of a child, the former certainly has a better right to its care and custody unless he is manifestly an Improper person to take charge of it, which does not appear to be so in this ,case In Lambert v. Lambert, 16 Or. 48 the father of the minor obtained the divorce and the court gave the cus tody of the child to the mother. The evidence was before the court on ap peal and was considered by them and upon that evidence they gave the custody of the child, not to the fa ther, but to J.'H. Lambert, the grand father. A Portland policeman was fired some time ago for telling his superior officer, when the latter inquired about some trouble between the policeman and his wife that "it was none of his d d business." The policeman was eminently correct, except as to the characterization of his superior's busi ness, and as he was an officer in the Portland police that was not, perhaps, far out of the way.
