The elective officers of the City of Salem, Oregon, shall be a Mayor and Recorder (who shall he ex officio Clerk of the Council), a Treasurer and two (2) Alder men for each ward. The officers to be ap pointed by the Common Council shall be a City Attorney and a City Kngineer, such City Attorney and City Kngineer to be ap pointed by the Council when deemed norm aary. Such appointive officers shall hold their renpective offices for the term of one ( 1 ) year, unless sooner removed by the Coun cil, and shall receive such salaries and com pensation as Ihe Council shall from time to time, by ordinance, direct. 1. Officers to be appointed by the Mayor. The Mayor shall appoint the Thief of Police and surh subordinate police officers an from time to time shall be deemed necessary, eaid appointments to he ratified by the City Council. He shall have power to remove atich Chief of Police or any nuhordlnato police officer summnrily with or without notice, and the Chief of Police and nil subordinate police men constituting the police force of the City of Salem shall hereafter he under the direct supervision and control of the Mavor of the City. Be it Knacted by the People of the City of Salem, Oregon: Section 1. That Section 23 of the above entitled act, being Section 23 of the present Charter of the City of Salem, Oregon, be amended ao as to read as follows: Section 23. The Common Connell shall not In any manner create any debt or liability, escept as in this Charter provided. At the end of each year an estimate shall be made of the actual revenues to be derivd from all source a. and from the total of that estimate the total of fixed charges shall be deducted, and the disbursements of the City Council shall ho restricted to the balance. No debts shall be contracted in excess of the estimated revenue, except as otherwise provded herein, and also except in the care of an emergency or unforeseen calamity, when the Common Conncil may borrow by giving a note er notes, or the issusnce of bonds, or otherwise, a sum not to exceed $20,000.00 to meet such emerg ency or calamity. The Council may call a special election to determine whether the city shall incur an Indebtedness, or may sub mit such proposition at any general or special election of the city. The ordinance calling auch special election shall be passed not less than thirty (30) days prior to such election, and shall set out the term of the proposed indebtedness, and the general purposes for which such Indebtedness will be incurred, and upon a majority of the qualified voters of staid city who vote at such election, voting In favor of authorizing the proposed indebted ness, the Council may then contract the same, and may by ordinance provide for the issu ance and aale of bonds to fund auch indebted ness. But auch indebtedness shall not ex ceed 15 per cent of the asessed value of the property in the City of Salem, except that any bonded indebtedness Incurred under the provisions of Subdivision six (6) of Section six (0) of this Charter, shall not be in cluded within the limitation of said indebt edness, neither shall bonds Issued for the improvement of streets or sewers, the coat of which is assessed against private property, under the provisions of the Bancroft Bonding Act, be included within such limitation of indebtedness. If at the maturity of any bonded debt of said city, no provisions shall have been made for Ihe payment thereof, and said city is without money to pay such Indebtedness, the Common Council may, and i hereby authorized to borrow money in the name of said city In sufficient amount to pay such Indebtedness, also to float a loan In lieu of that authorized in Ordinance No, 080, by the electors, August 2, 1909, also any other debt heretofore matured and unpaid, all by sale of bonds therefor at a price not less than the face value thereof, payable in nut more than twenty (20) years after date, and to bear interest at the rate not to exceed 5 per cent per annum. Provided, further, that for the purpose of raising the necessary funds to construct, repair and rebuild necessary bridges within the City of Salem, Oregon, the Common Council are hereby authorized to Incur an indebtedness to the amount of $40,000.00 by the issuance and aale of bond, payable in twenty (20) years from the date of Issue, with Interest at the rate of 5 per cent per annum, payable semi-annunlly. The interest to be paid upon snld bonds shall be evidenced by twenty (20) coupons, attached to each of such bonds, upon which shall be stated the amount of the interest at any In terest payment period of such bond. The Recorder shall have jur isdiction over the violations of city ordi nances, and may hold to bail, fine or commit persona found guilty thereof, and the law governing justices of the peace shall apply as far as applicable to all proceedings, bill he shall try all persons accused of violating said ordinances without a jury unless the de fendant, on demanding m Jury, shall deposit In court a sum sufficient to pay the per diem of such jury for one day. and witnesses in his court in such trials shall be entitled to no compensation for their attendance unless the Council by ordinancea shall otherwise provide, lie shall have power as Recorder to pnnish witnesses and others for contempt by a fine not to exceed twenty-five dollars $25.00), or in default of payment of auch fine, by imprisonment In the city jail one day for every two dollars of such fine; keep a journal of the proceedings of the Council, and perform such other duties as this Charter or the ordinances of the city require. The Recorder shall receive an annual sal ary of $1800.00 per year, payable monthly, as the salary of the other officers of the city are paid. Section 3. That Section 31 of the Charter of the City of Snlem. Oregon, being Section 11 of the above entitled act, be amended so ns to rend ns follows: Section 31. In case the notice be for the improvement of a street or pnrt thereof and the same shnll not have been defeated by a remonstrance, ns provided in Section 28. the Council shall direct the Mayor and Recorder of the city to enter into a contrnct with the person, persons, firm or corporation sub mitting the lowest bid ns hereinbefore pro vided, to make Raid improvement, and shall require any emh contractor to execute a I good and sufficient bond nnd undertaking In a sum equal in tne amount or tne contract price, conditioned to make said Improvement according to the plans and specifications, and according to the terms nnd conditions of such contract, nnd to complete the same '1lhin a reasonable time to lie determined by the Council. After such contrnct and bond are executed nnd the Council hnve thereby ascertained and determined the actual cost of such improvement, including a sum not to exceed 5 per cent of such contrnct price for engineering expenses, acquiring descriptions of property and other apecinl expenses con nected with making surh improvement, shall assess upon each lot or part thereof liable therefor, its proportionate share of such costs. Section 3. That Section 47 of the act of the Legislative Assembly of 1901, being Sec tion 47 of the Charter of the City of Salem, Oregon, be, end the same Is hereby repealed. Thst Section 4 of the Charter of the City of bslem. Oregon, being Section 4 of the above entitled act, be amended so as to read aa follows: Section 4. There shall be a general elec tion in the City of Silem on the first Monday of December, annually. A primary election for nominating candidates to be voted on at such city election ahall be held on the first Monday of November, preceding such election. Nominations of candidates to be voted on at such primary election shall be on petition and shall not have any partisan designation. A candidate for any office who receives a ma jority of all vot-i cast for such office shall be declared elected and no further election shall be held to fill that office. If there be three (3) or more candidates for nomination for any office, and no candidate receives a majority of all rotes cast for sncb office, the two candidates receiving the largest num ber of votes cast for such office shall be certified by the eanransing board as nomi nees for such office at the regular election. The primary election herein provided shall be conducted under the provisions of the Direct Primary Law, except that all nominations for city offices shall be non-partisan, and a candidate for nomination at the primary elec tion who receives a majority of all votes cast shall receive the same certificate of election as though he had been elected at the regular election on the first Monday In December.
