Offering to abandon all streets cov ered by Its franchise upon which It has not now constructed a tracK, anu agreeing to be satisfied with oe mala track on the east side of Front rt. with Industrial tracks and sidetracks, a common user clause to apply to the latter, the Portland, Eu Kene Kastern Railroad romimny submitted a compromise to the city council last night, and It was accept ed by that body. The compromise settles a suit com menced In the circuit court by the city to have forfeited the franchise of the company on the grounds that It had not eomulled with Its terms Judga Galloway, after listening to the evidence adduced, advised both parties to settle, and the above Is the result of the settlement. It Is furth er agreed by the compromise that the Southern Pacific is to be al lowed to use the track on Fron Btreet, and the company agrees t0 replace the rails nnw In position on Tenter street with 72-pound rails six Inches high, as soon as the pav Ing bricks on the street are so worn as to need replacing. The mayor has been ugalnst the railroad concern In the council, hut last evening, ac cording to his statement, a 1 tho con cessions asked for by the city had been granted, and ho was In favor of compromising the suit.
