The franchise provided that the written acceptance should be filed within 30 days e.fter the passage of tho ordinance. When it was discov- to'ered several weeks ago that the com- pany had not complied with this pro- vision the company's attorney de W. and M. dared that the acceptance had been filed, but that the; city recorder had 'lost it could not find it. The city recorder, on the other hand, claimed thnt no such paper had been filed wllh him at least not to his rec ollectlon. It was contended at the time by some that the company's failure to accept the franchise operated as a forfeiture) of It, and by others that it did not. It is maintained by those now who have Investigated the Bub Ject that, provided tho city makes no objection, but accepts the acceptance, that whatever defects may have ex- luted will be cured. The fine of $1000 was about, equal to fining the average man a nickel, and was there fore a farce.
