announced that he would follow out
the policy of having the various dis
trict attorneys bring the actions, and
In the event that they were unable to
do so that he would have it attend
ed to by the attorney-general.
The law provides that wherever
land escheats to the state, because of
the lack of heirs to claim It. that It
shall be the duty of the district at
torney for the district in which it is
located to bring the action. It Is
further provided that, in the event
that the district attorney shall not be
able for sprae reason to act that the
governor may appoint some attorney
and allow him to take 10 per cent of
the value of his property for his fees.
The practice has been In past admin
istrations to appoint attorneys and
allow them this commission, but the
governor has decided that this mon
ey might aa well flow Into the coffers
of the state. Should the district at.
torney directed by the gpvernor to
bring the action be unable to do so,
because of any good reason, then ar
rangements have been made by thV
governor with the attorney-general
to have aome member of his staff
bring it.
Escheat cases Involving about $30,
000 have recently ben called to the
attention of the governor, and these
will be considered at once.

and state prison was not legally held,

action In the circuit armrt asking
that it be declared void, and that the
city be restrained from collecting
$23,000 in the way of assessments
made for street improvements, and
should he prevail in his suit, it will
mean the decrease of the population
of the elty to the extent of 3000 peo
ple. Shortly after the annexation elec.

ue.and to asesss the cost of the im
provement to the abutting property
owners.and it is the collection of this
tax that - it is desired to have en
joined. The contention of the plain

ployes of the asylum1, and, that while
they have a residence that entitles
them to a vote at genteral elections.

them to vote at special elections, and,

To be struck full and square by a
swift moving automobile and be tak
en off his feet and hurled over an
embankment 20 feet In height and es
cape without any apparent Injury,
was the experience of J. G. Mather,
a farmer living on the Slough road
about four miles from the city.
Mather was returning from a visit
to the city and, according to people
at a ranch who saw the accident, had
Imbibed somewhat In the liquid that
cheers. He was taking the middle of
the road like a populist and when an
automobile the owner of which Is
unknown came sailing along the
road, the screams and shrieks of the
horn failed to arouse him. When It
became apparent that he could not
be aroused the driver of the machine
sought to turn to one side and Just
as be did so Mather evidently heard
the machine and leaped In front of
It. The result waa that he was struck
by It and hurled over a 20 foot em
bankment. Fearing that he was bad
ly Injured, occupants of the machine
started to assist him, but when they
looked over the embankment where
he had fallen, they found that he had
gotten up, was brushing the dirt off
his clothes and violently cursing
"stink wagons" In general. When
his toilet had been completed, he pur
sued his Journey as though nothing
whatever had happened.
