"After we have a few more meet ings I think we will convince the en gineer that the plant Is not worth 30 cents more than we have offered for it," said Councilman Lafky last ev ening, in reporting on the negotia tions under way by a special commit tee for the purchase of the water plant of the Salem Water Company, and in requesting that another week be allowed the committee to continue the negotiations. The commttee had promised faith fully to make complete report last ev. ening, but circumstances over which It seems to have had no control, pre vented. Mr. Lafky announced that several conferences had been had with R. M. Donald, the engineer represent ing the company, and that much data and figures had been considered. As above Indicated, he voiced It as his opinion, that the committee was pre vailing upon the engineer to come around to its views as to the value of the plant, and that by another week the committee will be ready to give a complete report. The additional week was granted the committee, and it seems certain that a report on the subject will Ho forthcoming at the next meeting of the council. GASOLINE EXPLOSION DESTROYS AUTO FACTORY Kokomo, Ind., Feb. 28. Fire result ing from the explosion of gasoline in the engine room this afternoon total ly destroyed the Haynes Automobile factory. Vesete fall ing in this will be held up at Angel Island for tlrorough investigation. o SUPREME COURT HANDS DOWN FOUR OPINIONS Declaring that where a city Incurs a debt for street Improvement work and agrees to create a special fund for the payment of the work, and then unreasonably delays in the creation of the fund, that the con tractors have under the law of the state the right of an action against the city, the supreme court this morning reversed the circuit court of Multnomah in the case of J. P. Neil, appellant against the city of Port land. A warrant was drawn in favor of Neil, it seems, for the sum of some $700 for the improvement of Gold smith street. It was drawn upon a special fund created by an ordinance but which ordinance was declared In valid. For five years the contractor waited for his pay and finally an ac tion was brought against the city for damages amounting to some $7,000. The city demurred to the complaint on the ground that it did not state facts sufficient to constitute a cause of action and the circuit court up held it. The supreme court now re verses this decision. Three Other fuses. Decisions were rendered in three other cases and they were as fol lows: ' ' L. B. Kinney, appelant against Ber that O. Smith and her husband, R. H. Smith, an action from Coos county, brought to have a deed declared a mortgage, judgment bf; the lower court modified, ' J. C. Bradlt against M. J. Sharkey, an action brought In the circuit court of Clackamas county and the object of which was to- quiet title to a tract of land, Judgment of the lower court affirmed. F. S. Dow, respondent against the Courteney Lumber company, et al, an action brought In the circuit court of Coos county and the purpose of which was to foreclose a mechanic's Hen, Judgment of the court affirmed. Cakes Hena Baking Easy Announement is made today of the opening of Oak Lodge, tract of land that has long held back the spread of Salem's population on the east. Oak Lodge is two blocks from the Park school and is to be the closest in addition on the market. The city has built up far beyond it on both sides, and, in this respect, resembles more the Ladd tract In Portland, now called Laurelhurst, than any other property in Salem. There are acres In the piece comprising 190 lots and as soon as the plat is approved, which will not be later than Friday the addition will be of fered for sale. Oak Lodge is within easy walking distance to the business district and this feature alone Involves a saving to the average family of from $3 to $10 per month, averaging about $80 per year, or 8 per cent on an invest ment of $1000. The timber has been removed from the place leaving beau tiful oaks here and there to afford ornament and shade. All the stumps and brush are under contract to be removed and streets are now1 being graded. Every block has alleys, and city water is already on the place. The now sewer now being constructed will serve Oak Lodge, and all sewer and street Improvements are to be paid by the present owner. Electric lights are' likewise to be extended over the addition and everything done to make it convenient and up to date. All surface water flow Is to be kept off the premises and confined to proper channels. Its elevation is high and with a gentle slope to the west. The original intention of the owner was to withhold the sale of lots until the property was fully Improved, but such has been the Inquiry and de mand for lots that It has been decid ed to open the tract for sale with the improvement guarantee as soon as the plat is completed. Already two modern houses are under construc tion in the addition and indications are that the record for building this year at Oak Lodge will be a pace set ter for Salem.
