Contending that the grand jury,
in condunting its proceedings in the
case of Thomas O'Rourke at the state
prison, Instead of the court house, ex
ceeded its power and jurisdiction,
Wm. P. Lord, Jr., his attorney, has
filed a motion with the clerk of the
-irouit court asking that the indict
ment preferred aga4nst O'Rourke be
set aside on the ground that It Is
void.
O'Rourke was Indicted by the jury
on the charge of an assault with a
deadly weapon upon Jerry. Simpson,
a guard at the state prison, and in
which Institution O'Rourke was con
fined. As It was necessary to exam
ine a number of corVlcts of the insti
tution, the jury held Its sessions at
the state prison, as a matter of con
venience. Attorney Lord contends that this
could not be legally done without a
special order from the court, which
was not secured. While he admits
that there is no statute providing
that the grand jury shall hold its ses
sions at the court house, he ' main
tains that under the common law that
the grand jury was an appendage of
the court, and sat with the court in
its deliberations, and that in the ab
sence of a statute on the subject that
the common law Is In full force and
effect.

Because In its opinion the Portland
Railway, Light & Power company has
failed to comply with an order issued
October 22, 1910, directing it to keep
its cars ventilated, well heated and
otherwise comfortable, the state rail
road commission has directed the at
torney general to commence a suit
against the company to recover the
penalty provided by law for the viola
tion of orders of the commission.
The commission says that the con
dition of the cars in the matter of
heat In the winter time has been re
peatedly called to the attention of the
company but that it has not heeded.
Last October an order was made di
recting the company to keep its cars
heated, but that also the commission
maintains has been violated and it
now Insists on the attorney general
bringing the suit as Boon as possible.
The portion of the line complained
of is between this city and Portland.

filing of divorce papers will be
stopped if bills introduced in the leg
islature today are enacted Into law.
The present statute prohibits the
county clerk from allowing Inspection
of divorce records. The proposed law
removes that restriction.

Mrs. John Gowan telephoned this
message to her husband after she had
been fatally burned by an explosion
of a gasoline iron. .
Her husband ruahed home, extin
guished the blaze and endeavored to
revive his unconscious wife. Physi
cians were unable to save the wo
man's life. Mrs. Gowan attempted to
refill the iron and an explosion followed.
