KIKRMAN WANTS THE
MATTER RE-HEAIll
A petition for a rehearing in the
case of Frank Kiernan against the
City of Portland was filed this morn
lug with the clerk of the supremo
court.
Ths case was Instituted by Kler
nan against the city of Portland
with the view of preventing the Issu
ance of bonds for the construction of
what Is known as the Broadway
bridge across the Willamette river
on the ground that the provision of
the city, charter under which th
bonds were issued had not been
adopted in a manner provided by
law. Both the circuit and the su
preme court decided In favor of the
city. The attorneys of Kleruan now
contend In their petition for rehear
ing that there are spine grave consti
tutional questions Involved, both
federal and state, and that In order
that the court may Intelligently deal
with them, a rehearing Is necessary.
