Pacific against the California Devel
opment Company for payment on a

to the road by officers of the devel
opment company, with the consent
of its directors. The money ad
vanced on the notes, it was stated,

rowed tho Southtern Pacific com
pany entered into a contract with
the development company, which
provided that the railroad corpora
tion would appoint three members
of the directorate of tho diovelop
ment company, with the addition of
naming the president. Tho presi
dent was e'mpowored to appoint the
executive officers and chief engi
neers employed by the company. In
the suit which was decided late yes
terday, the development company
alleged that !the Southern Pacific
entered into the agreement in order
to control rich water rights whleh
gave It practical control of the val
ley. John D. Works, counsel for the
development company, refused to
state whether further action in be
haif of his client would be taken.

Peary, tho Arctic explorer.
Tho magazine has contracted for
Peary's story on his dash to tho
north pole for which it has agreed
to pay him $50,000, the narrative
to appear in serial form in ten con
secutive numbers. Peary already
has already been paid $25,000.
Thle insurance policy was taken
out by the corporation to avoid loss
should Peary die while on his lec
turing tour.

damage, has been wrought by the

Indies Wednesday and Thursday, ac
cording to reports received here to
day. J It is feared that there will bo a

nication disrupted it is impossible to
ascertain tho true situation.

The storm which swept Jamaica
is now moving in the direction of tho
Bahamas and Bermuda.
No less than forty-eight inches of
rain fell at Kingston while tho storm

has played havoc with tho banana
crop. If this proves to bo true It
will cause great suffering In Jamaica

Railroads have been wrecked and

a number of craft, unablo to weather
tho gale, went down.
