1901, and sontoaced to hang, to 15
years' imprisonment, with tho view
to giving tho man an Immediate pa
role Duckley will be pardoned at
tho end of two years, if ho has made
good on his parole
After a battle In tho circuit courts
of I'oiK anu TiuamooK counties ex
tending over four years, A. J. Hem
broe, who was sontenced to death for
the alleged murdor of his wife and
daughter at Sandlake, Tillamook
county, and Upon which Judgment
he appealed to tho supremo court,
was given anotner cnance to clear
himself, In un opinion handed down
by Oregon's hlghor tribunals this
morning reversing the decision of
the lower courts nnd orderng a new
trial.
Hcmbrco was tried and convicted
bofore Circuit Judge McDrldo of till
amook and was sentenced by Judge
llurnott In Polk county. In tho year
i906 tho homo of tho Hembrco fam
ily at Sandlake was burned, and upon
an investigation thoro was found In
tho ashes two headless skoletons, sup
posed, nnd nttorwurds proved, to be
tho remains of Hcmbrco's wife and
daughter. A chargo was placed
against tho husband which was un
dertaken to bo established by tho fol
lowing clrmustunccs:
Ills sons were away from home
when tho house burned; when tho
skuloton was discovered thoro wore
no skull bones seen, and tho finding
In tho broken parts of tho stovo tho
skull bones nnd an artificial tooth.
These constituted tho basis on which
tho verdict and Judgmont rested.
In giving testimony in his own be
half Hombrco told that aftor ho had
retired and was asloop ho was awak
ened by tho strong odor of smoke in
his room, which was upstairs and
over tho room occupied by his daugh
ter, Ora. Ho at onco aroused his
wlfo, who was lying bestdo him. and
thon tho daughter was awakened.
After carrying out sovornl articles

or wator .on it, tiut owing to the
handles of tho tub coming off thoy

brco thon told of his hurried Journey
to a neighbor's houBO and how, ow
ing to n recent rupture, ho was un
ublo to travel with much rapidity,
and nftor ho roachod tho houso ho
fainted nnd could not glvo an ac
count of tho affair. Ho thon gavo an
explanation regarding tho teeth
which ho said ho und his brothor ex
tracted from tho ashes and laid to
ono side preparatory for burial along
with tho bnlnnco or (ho remnlns.
Tho opinion of tho supromo court,
which wns wrltton by Chief Jus Ico
Moore, holds thnt circumstances must
bo established by direct proof and not
to bo bnsod on Inferences us was tho
case during tho trlnl in which It was
Inferred that Hombreo, after Bovorlng
tho heads of Ills wlfo and daughter,
put tho membors In tho stovo nnd set
tho houso on flro. Thoro waft no di
rect ovldonco of Incriminating nature
Introduced by tho state during the
trial that was based on actual proof
nnd tho fact that tho conditions of
he bodies nnd tho locations of the
romnlns wero such as to lonvo some
doubt In tho minds of the Jury, there
was no dlroct Indication that Hem
brae wns guilty of tho crime charged
Another contention and inference
drawn by tho stuto wns that Hem
broo wns guilty of having Incestuous
relations with his daughter Or.) dur

leged homicide, which nlso whs con
sidered n motivo for destroying the

argued that testimony given by n

in Tillamook county, did not prove

the alleged crimo Hembreo and his
daughter had been to n school enter-

said thnt after tho daughter had been
shown to her room Hembreo caljed
and wnntod to seo hor, but Larsln
would not pormlt it This was re-
pented by Hombreo, ncqordlng to Lnr-
sln s testimony, anu iiemureo wiauuu

coming down stairs nnd later discov
ered marks whero Hombreo had been
loaning ngnlnst tho wall. Ho did not
state, though, that ho had actual
proof of Hembreo being In tho room.

from tho hotol who said they had
been taunting Hembrco concerning
his inability to purchaso liquor in
Tillamook, which was consldorod
"dry," and thnt Heynbrco, in a de
termination to prove thnt no couiu,
went across to tho hotel to socuro
some money, which, ho said, was all
given to his daughter for safo keep
ing. Chiof Justico Mooro holds that tho
fact of Incest wns not established,
Larsln's testimony was not connected
and an orror was committed in re
ceiving his sworn stntomonts, in con
sequnece of which Judgmont Is re
versed and a new trlnl ordorod. Jus
tice McDrldo did not set in tho hear
ing. LAWYERS NOT ALL

Just been acquitted of murder in tho
first degrco In tho supromo court,

great fight, with tho nross and gen
eral suspicion against thorn. To the
credit of Oregon lot It bo said a man
cannot bo hung by tho nowspnpors,
nor on general suspicion.
