that tho plaintiff in tho caso is owner

tho lands, as alleged In tho com
plaint, a largo amount of accretions
havo added to tho tract of land by
tho gradual deposit of sand In tho
Columbia rlvor, until tho original
land is now increased until It com
prises about i00 acres, which accre
tions tho plaintiff also claims.
Anothor allegation in the com
plaint Is that M. Troyor surveyed a
portion of tho land, Including tho
accretion, npd applied to tho Stato
Land Board for a lease for 10 years,
whereupon tho land board published
notices of application, and ndvortlsod
thoy would receive bids for loosing
tho land to tho highest bidder, and
Troyor ontorcd ns a blddor, and on
July 12. 1909 (today) tho Stato
Land Board was to consider tho bids.
Tho plnlntlffs claim that during
tho fishing season thoy aro accus
tomed to catching 50 tons of salmon,
aggrogat'ng n vnluo of $5000, and If
the Stato Land Board awards the
loaso to Troyor, It will work Irre
parable Injury to their business, as
ho (Troyor) has horses, men and nets
located In closo proximity to tho
Innds In question, and Is prepared to
tako up tho fishing placo as soon as
ho Is given tho leaso, and. In addi
tion to tho tompornry Injunction, a
porpotual Injunction Is prnyed for
ngaliiBt tho Stnto Land Board, to
prohibit It leasing tho Innds- In
qilcstlon.
