After four years of litigation, tho
fight between tho Chcwnucnn Land
& Cattle company, asubsldlary to
the firm of Miller & Lux, California
"Cattlo Kings," nnd half hundred
settlers" of tho rich farming and
grazing lands along the Silver
Creole river In Lake county for water
rights, was argued at length before
the supreme court horo yesterday.
Tho suit for tho water rights was
originally before Judge H. L. Benson
In .the circuit court of Lake county.
After a year and a half of stubborn
fighting for tho control of tho river,
Judgo Benson rendered a decision in
favor of a majority of tho settlers,
and agalnBt tho Chcwnucan Com
pany nnd tho remaining settlers.
Tho enso wns then submitted to tho
supreme court, boforo whom it ha?
slnco been pending.
It Is tho contention of tho CJiewau
enn company, who own a vast area
of land around tho Pauline marsh,
Into which tho Silver Creek river
empties, that tho settlers along the
river ubci up tho water before It
roaches tho marsh, thereby leaving
tholr lands In an arid and unpro
ductive contTItion.
Attorney B. P. Watson of Portland
represented tho Chownucan company,
which concern Is one of the defend
ants nnd appellants, whllo tl. C.
Rutorlc, npponred as attorney for tho
plaintiffs and respondents. Tho su
premo court will probably decide tho
enso within tho next month.
