this matter before your honor takes
any action. The first ofllolal Infor
mation that wo have had to the ef
fect that the state intended to pro
ceed against him was this morning.
Mr" Ruof has certain constitutional
rights, rtmny of which were wrung
from him by the urosoeutlon. I do
not think tho inter oats of justice will
suffer If he is given a chance to
place himself In a position to meet
this change of front upon the part of
tho prosecution. I will ask now that
It Is their Intention to proceed
against him, that he be given time
to s jcure counsel who will be able to
do him justice In thte orltloal situa
tion. I ask at least a continuance of
two or thre eweeks. and that an oiv
der be made allowing him to leave
the county jail at long as may be
necessary for him to secure capable
counsel."

to the effeot that Ruef bad not been
notiflod that he would be placed upon
trial until this mornlag, and declared
that bo had notified him last Satur
day. Keane again requested tkt
court to allow his client time to se
cure counsel, stating that he. a

ficially notified of the prosecution's
plans until this morning.
