Although several other prominent
men wore Indicted with him, Sena
tor Bornh has been granted tho
privilege of a separate trial. Wit
nesses have been subpoenaed for
Monday, the dato set for tho begin
ning of tho trial, and lt is believed
that there will be no delay, as Borah
has been insistent in demnnding an
Immediate trial.
It is likely that tho trial of George
Pettlbono, who wub indicted wit,h
Haywood and Moyer for tho mur
der of ex-Governor Stoun'onberg,
will have to bo postponed na a result
of tho Borah trial. In that case, at
torneys for tho Western Federation
of Miners will probably demand his
release on ball. If Bornh should.be
convicted it is gonornlly believed
that tho case against Pottibono nnd
Moyer would bo dropped. Borah
has been the mainstay of tho state in
the prosecution of tho federation
leaders, and If ho should bo con
victed of n crlmo It would servo to
thoroughly discredit the state In the
Stcunonborg case.
Tho case for tho government will
bo conducted by Attorneys B. M. C.
Burch of Denver nnd S. H. Rush of
Omaha. The latter is a special as
sistant general, representing tho de
partment of Justice. Ho has re
lieved District Attorney Rulck in
these cases, owing to tho allegation

called. Ho stated Rulck had coma

that day. Asked if Rulck had mado
an argument about It, ho said Ruick
had mado what ho considered an ar
gument. Ho snld Ruick said tho re
