TALKS ON
RAILROADS
Tom Aaoress ai Kaieign,
North Carolina. Oct
ober 19, 1$05
Tho cardinal features of tbeso chang-
il conditions aro, first, tho fact that
now highway, tho railway, Is, from
commercial standpoint, of Infinitely
rrcat Iraportanco than was tlio old
liighway, tho wagon road; and, second,
hat this now highway, tho railway, la
tho hands of private owners, where
i tho old highway, tho wagon road,
as in tho hands of tho state The
nauagement of the now highway, the
nilroad, or rather of tho intricato web
of railroad linos which cover tho coun-
try, 1b a task Infinitely moro difficult,
moro dollcato, andi moro Important than
i. nrimiik'iv Miitv task of acauiring
or koopftg in order tho old highway;
so that thero is propony no nmuutf
nhnlnvnr botweon tho two CaSOS. I do
not boliovo in government ownorshlp
of anything which can with propnoty
bo loft In prlvato hands, and; In partic
ular I should mosb stronuously objoot
to trovernmont ownership of inilroads.
Bub I boliovo with equal flrmnoss that
it is out of tho question for tno gov
ernment not to exorciso a supervisory
and regulatory right over the railroads;
for H is vital to tho wcll-bolpg of tho
public that thoy should bo managed In
a spirit of falrnesa and justice townrd
all tho public. Actual oxporionco has
shown that It is not posslblo to leavo
tho railroads uncontrolled, bucn a
system, or xathor a lack of system, la
fortllo in abuses of every ktnu awl
puts a premium upon unscrupulous ami
ruthless cunning in railroad manage
ment for there nro florao big Bhlppera
and somo railroad managora who aro
always willing to tako unfair advantago
of their woakor competitors, ana tnoy
thorobv forco other big shippora nnu
Ug railroad men who would llko to do
docontly Into similar uots of wrong and
inlustjco, undor penalty of bolng ion
fbohlnd In tho raco for success. Gov
urnmont supervision is nooded quite as
much In tho Interest of tho big shipper
and of tho railroad man who want to
do right aa In tho intorost of tho small
shipper and tho consumer.
Bxporlcs'io has Bhown that tho pres
ent laws are dofectivo and noed amond
moot. Tho offort to prohibit nil ro
stralnt of competition, whether reason
ablo or unreasonable, is unwiso. Wlint.
wo need in to liavo somo administrative
bodv with amnio power to forbid com
bination that Is hurtful to tho public,
and to provont favoritism tq ono indi
vidual at tho ozpenso of another. In
other words, wo want an administrative
body with tho power to securo fair and
just treatinont as among all shippors

hrvo a Tight to uso them, wo must not
loavo tho onforcomont of such a. law
merely to tho dopartmont of justlcoj
dt Is ou of tho question for the law d1
partmont of tho govornmont to do whnt
should bo purely administrative work.
Tho !opartmont of justlco is to stand
bohind and co-operato with tho admin
istrative body, but tho n'dmlnistratlvo
body Itsolf must 'be given tho power
to do tho work and thon hold to a
strlot accountability for tho exorciso
of that powor. Tho dolays of tho law
nro proverbial, nnd what wo nood in
thiH matter is reasonnblo quickness, of
action.
Tlio abuses of which wo havo a, gen
uino right to complain take mauy
shapes. Bbatcs a'o not now ofton
given openly. Iiuf. thoy can bo glvon
just as cffoctlvoly'ln covert-fojm; and
prlvato cars, terminal tracks and tho
like must bo brought under tho con
trol of tho commission' or administra
tive body, which is to exercise super
vision by tho government. But. in mj'
judgmont the most important thing to
do is to glvo to this ndminlBtratlvo
body power to mnko Its findings effec
tive, and this can be done only by glv
to rallroadb that Is now oxorclsodl as
a mattor of course by tho national bank
examiners as regards national banks.
My object In giving theso additional
powers to tho administrative body rep
resenting tho govornmont thelntorstato
commerco commission, or whatover it
may be la primarily to socuro a roal
nnd not a sham control of tho govern
ment roprosontativos. Tho Amorlcan
pcoplo abhor a sham, and with this
abhorrence I cordially sympathlzo.
Nothing Is moro injurious from overy
standpoint than a law which is merely
sound and fury, mcroly protonso, and
not capablo of working out tangiblo
results. I hope to soo all tho power
that I think it ought to havo grunted
to tho government) but I would far
nitlior boo only somo of It granted, but
really grantod, than soo a protenso of
granting all, in some shapo that really
amounts to nothing. "
It must bo understood, as a matter of
course, that if this power is granted it
la to be exercised) with wisdom and cau
tion and) solf-restralnt, Tho interstate
commerce commissioner or other gov
ernment official who failed to protect
a railroad that was in tho right against
any clamor, no mattor how vlolont, on
ing it power, when complaint Is mado tho part o tbe pubHo wuW hQ my

of a given rate as being unjust or un
reasonable, if it finds the complaint
proper, then itself to fix a maximum
rate which it regards as just and rea
sonable, this rate to go Into effect prac
tically at onco, that is within a ronson
ablo time, and to stay in effect, unless
roversed by the eourts. I earnestly hope
that wo shall boo a law giving this
powor passed by congress. Moreover,
I hope that by Jaw power will bo con
ferred) upon representatives of tho
government capable of performing tho
duty of publio accountants carefully
to examine into the books of railroads,
when so ordered by the Interstate Com
merce Comaris&lon, which should itself
have power to prescribe what books,
end what books only, should bo kept
by railroads. If there Is in the minds
of the commission any suspicion that
a certain railroad Is In any shape or
way giving rebatos or behaving improp
erly. I wish the commission to bave

1 1 matter of favor, to make a full and
exhaustive Investigation of the receipts
and expenditures of the railroad, so
I that anji violation or evasion of the law
may bo dotected. This Is not a revolu
tionary proposal on my part, for I only
wish the tamo power given in reference
of us gross a wrong as If ho corruptly
rendered an improper servico to tho
railroad at tho oxponso Of Jho public.
AVhon I say a squaro deal I mean as
much a squaro deal for the rich man as
for tho poor mau; but no moro. Lot each

him, and bo judged according to his
deserts. To moro he is not entitled,
and less ho shall not have.
