Murphy has commenced a suit to enjoin County Assessor Lembcho, County Cleik Roland, Sheriff Culver and tho city of Salem from levying a tax against his property situated inside of the present city limits of Salem. The suit was filed late Sat urday afternoon and is brought for tho purposo of testing tho now char ter of tho city. W. H. Holmes and M. E. Pogue aro attorneys for the plaintiff. The complulnt alleges that tho plaintiff Is the owner of 20 acres of land near tho fair grounds, and If the defendants are allowed to enter his name and property on the tax roll that ho will suffer heavy loss, and asks that they bo porpetually enjoined from so doing. Plaintiff owns 20 acres of land used for a tllo works south of tho fair grounds and Is within tho new city limits as defined by the charter passed at tho session of 1903. The move has been under way for several months and Is a concerted action on tho part of a number of property owners In the new wards who are dissatisfied with tho now charter. The vote In detail on tho amend ment was as follews: Ajos Walker, Acheson, Churchill, Crossan, Gesner, Hubbard, Hughes 7 Noes Bayne, Catlln, Jacobs, Young, Downing 5. The vote on tho amendment of the resolution stoed: Ayes Walker, Acheson, Cro3san, Gesner, Hubbard, Hughes, Young 7. Noes Bayne, Catlln, Churchill, Jacobs, Downing 5. Tho resolution offered by Alderman Downing provided for improving the street to recolvo tho now Breyman fountain. The resolution lea to a hot debate, In which overy member of tho council Indulged. The argument was advanced that Mr. Breyman had offered to Install the fountain free of charge to tho city and that It had been accepted under that condition. Now to appropriate $500 from tho treasury would not be a Justice to tho taxpayers and that the city was in need of tho funds for other work. On tho other side It wns contended that It wa3 a great Improvement and as it was furnished freo of charge to tho city It should bo accepted undor the new conditions. The resolution was finally adopted as amended and the park board will be short of funds for the remainder of the year. The council was also notified that J. E. Murphy had commonced a suit to test the new charter and tho may or was empowered to employ attor neys to conduct the defense. The bid of tho Citizens Light & Traction company for furnishing light for tho city at $6.50 per light per month was continued. Liquor llconses weio granted J. P. Rogers at 1C0 State street and 102 Court street. The committee on street was or dered to notify tho Salem Flouring Mills company to cover tho Front street ditch. Street Commissioner Tarploy was Instructed to open tho bridge on Church and Mill streets. Tho new street numborlng ordi nance, as publlzhodi elsewhoro, was read twice and roferred to tho stroot committee.
