Jesse Kirk the Well Known Indian Preacher Claims His People Have Owned the Land for More Than a Thousand Years Tribes Have No Legends Tending to Show They Ever Lived Anywhere Else. Rev. Jesse Kirk, a wall known In Ulan of the Klamath tribe belonging to -the Klamath Agency publishes a letter in yesterday's issue of tho Ore gonlan in which he ably defends the rights of this people against the claim of Oregon to 100,000 acres of swamp lands, part of which has already been allotted to the Indians. Mr. Kirk says in part. The Klamaths, Modocs, and Yahoo kin band of Snake Indians of the Klamath Indian Reservation in the State of Oregon, and the aboriginal in habitants of the country ceded to the United States by them. Their rights and titles to all the country claimed by them must be a thousand .years old, or more, as the oldest Indians re member what was expounded to -thorn by their ancestors hand?d down generation after generation. -They have never heard of their be ing drivon from any other country by war or desperation. All they have ever heard from the preceding gener ations is, that they were living ho re in Klamath county quietly, unmo lested, and pursuing tha necessities of their lives. There are many pre hlstorical evidences in the country of the traditions banded down to us by our ancestors. Also the peculiar land marks tliroiielinnt the entire country prove the fact that we Indians are possessors and had possessed the land long before any Anglo-Saxon knew there was any such country as Oregon or Klamath, therefore the , Government of the United States ac knowledged our ownership and enter- 1 ed into negotiations. J. W. Perrltt, Huntington,. and William Logan, wore appointed Commissioners on the part of tho United States. A treaty was negotiated In 18G4, by the united States with tho Indians aforesaid, which was concluded October 14, 1SC4, was amended by tho Senate, and finally ratified, and proclaimed February 17, 1870. By the first ar tlclo of this treaty the said Indians surrendered tholr right, tltlo and claim in and to about 20.000.000 acres .of land In Orogon, and Northern Cali fornia, a reservation for tholr future uso and occupancy being reserved by tho treaty within tho ceded torrltroy. The Indians fully compiled' with tho provisions of tho treaty by settling and removing within tho limits of the rosorvntlon thus created for them. Not only did thoy romove and settlo within the limits of the reservation, but more than that, thoy havo re mained loyal and true to tho solemn treaty stipulations nnd with ready hands to assist the United States, in case any of the surrounding tribes or nations are hostile to the United States. They have shown this in both tho Snake war in Eastern Oregon nnd the Modoo war in Northern Cali fornia. Henry Blow, the last and only load ing scout and chief living, is old and feeble, living on Williamson River. After chlefmanshlp was abolished by the Indians, he was appointed a police man on this reservation, which duty he faithfully executed for over 20 years. We have been loyal to the solemn treaty stipulations until today, and therefore bolle'o that tho Government of the United States Is under logal ob ligations to protect us poor, Ignorant Indians. On this serious question, to which we have seen many references in the papors latsly, namely, the claim of the State of- Orogon to the swamp lands on the Klamath reservation to the ag gregate number of 100 000 acres of land, I would say that this Is a serious mattor to us, as tho area. nntnrtd rrtara A)( nllntmnnta n t iofi r 1 1 made, and also includes much land on which wo hope to havo allotments made to the children who havo been born within tho last three years, ns already authorized by an act of Cong ress In 1902, and to adults also who wore ovorlookod herotoforo by the nllotlng ngonts, as thoy were absent while the work of nllotlng lands was going on. If tho state should secure thoso lands thero aro no others that could be allotted to tho Indians in their stend, that would begin to com pare with them In value for home and, In fact, on which so largs a num ber of people could make a living. It is no doubt true that the state has a legal claim against the General Government to the value of 100,000 acres of undralned swamp laud, the area of that which is ascertained to lie in' the Klamath reservation. But certainly tho General Government will settle with the state this liability and leave us In undisputed possession of the lands which it has as solemnly promised us, and upon which we havo made extensive Improvehments, through much labor and at great ex pense. I have undertaken to show tho forogolng original possess ory rights of tho tribes, and with Arm reliance on tho groat ruler of heaven and earth, and with firm con viction that his purposos must pre vail, I pray the genoral Govornmont will do us justice.
