Mltzlor, a German farmer from Ma
rlon, was driving out of tho city on
his way homo, and while on tho coun
ty ,road beyond tho penitentiary, npar
tho Aufranco home, nn automobile
passing him at full speed, frlghtoncd
his horso, causing him to run awny,
and, beforo ho could be caught, ho
fell dead on tho road.
Mr. Mltzlor and his eon, in a Uug
gy woro driving along tho road, whoro

whon, on nenrlng a bend In tho rood,
thoy mot tho automobile, comlug at
a rato of from 15 to 20 miles an hour.
Motioning frantically to tho chttu flour
to stop tho machine, Mr. Mltzlor drow
his horso to tho sldo of tho road, and
went to tho nulmnl's head to bettor
control him, but tho auto camo on at
full speed, and whizzed by. This so
frightened tho lioroo that ho plunged
and ran away, trampling on Mr, Mltz
lor, and dashing down tho road. lie
ran for a halt mllo, to whoro a crowd
on tho highway Interfered with hs
furthor progress, when he .turned In
an effort to rotraco his steps, but foil

had expired, having sustained somo

tho team was attached was badly
wrecked by tho frightened animals,

Mr Mltzlor camo to town during the
nftornoon and swore out a warrant for
tho chauffeur, charging him with
grossly Injuring tho porsoual proper
ty of nnothor. Tho namo of tho driv
er of tho auto was not known, and It
was found difficult to arrest tho right
man, It was supposed to bo Ed. Mc
Callahqn, of P6rtland, but that gen
tleman proved boyond question that
ho had not boon on tho penitentiary
road during tho day, and ho was not
