In support of his application for a
new trial, McMahan cited a number of
reasons. He claimed that the court
erred In admitting: the testimony of
Hofer Hroe. and J. W. Cochran to the
effect that at the time the alleged
libelous article wsa published that one
of the editors waa out of the city
