that a new telephone directory is be
lug printed, and will be ready fof dis
tribution to subscribers within a few
days. The printing of the directory
has bee delayed, or It would hare
been Issued some time ago. There
are now 71S subscribers on the local
exchange, and the new directory will
be much appreciated. 'for Its need has
been apparent for several weeks.

hold that there was but a slnale ques
tion involved, and tiiat was as to
whether or not the work was per
formed at an agreed price, or was left

the weight of the testimony was in
favor of the defendant, since the plain
tiff's main witness failed to substan
tiate bis contentions, and the further
natural custom that a man ordinarily
has some definite understanding with
workmen as to the probable cost of
an undertaking before It Is er
fotmed. The court held that the plain
tin failed to sskabmth a Hen against
the defendant,' and ordered the case
dismissed, and the costs assessed to
the plaintiff, who appeared by M. B.
Pogue. The defendant was represent
ed by Donham & Martin.
