further Use and pleaded guilty to the
charge. Thursday at a. m. was the

tion to dissolve the attachment was
overruled, and the motion to quash
the summons aad the service of the
same was sustained.
Jacob Leldenger was sworn in as
third bailiff, who will be in charge of
the Jury in the Markley case until a
verdict is reached.
Markley Case Called.
The Markley case was called at 1 :
o'clock. District Attorney J. N. Hart
and Deputy John H. McNary and C. M.
Inman appeared for the state and
Markley is represented by John M.
Gearln. of Portland, aad Carson &
Adams, of this city.
The first twelve men called to the
jury box were R. B. Duncan. O. I.
Morris. A. Daue. W. P. Miles. T. C.
Davidson. John C. Savage. I H. Pou
jade Alonso MoffitL D. Bowerman. F.
A. Wiggins. D. Steiner. James H. Pat
ty and W. II. Downing. There is not
a very large attendance at the trial.
Of the flrst body of jurymen called.
Duncan was peremptorily challenged
by defense, as was also Miles. O. I.
Morris. A. Daue aad T. C Davidson
were excused. John C Savaga, a
rousln of J. H. McNary. was excused
because be did not believe in Inflict
ing capital punishment, when even a
part of the evidence was of a circum
stantial nature. L. Poujade, & farmer
of Gervals precinct, was the first juror
that was accepted by both sides. The
examination of the other jurors is In
progress as this report closes.
History of the Case.
At an early hour Wednesday morn
ing. June Stth. John D. Fain, a retired
merchant, of Champoeg, was shot and
killed at the rear of the store of John
F. Markley, bis former partner Mark-
ley waa arrested, charged with the
crime. He protested his Innocence,
but, upon the showing made at the
coroner's inquest, all of the evidence
being of a circumstantial character,
the jury charged Markley with the
crime. The accused man was given a
preliminary examination before Form
