AN INDEPENDENT PAPER FOR THE PEOPLE.
Legal Divorce
At San Francisco vory Itov. J. J.
Prondoriiast. tho vlear-gonoral of
this archdiocuso, as n prelude to his
Bormon, donned Bomo of tho points of
,ioctrno nim discipline of tho Catholic
chiireh relating to tho subject of di
vorce. Ho said In part:
Inasmuch as divorced parsons are
Bomotlmos marrlod In tho Catholic
church, many people arc porpldxod, be
aa a dissolution of tho marriage tic.
Honco not a few find thomsolvoa un
able to reconcile what they consider
tho dlsclplino with tho practice. In
reality thoro is no conlllct between tho
church's disciplinary laws and tho
church's acts. Tho oxplanntlon of the
apparent conlllct Ib vory simple The
church never- nccopta tho dlvorco de
cree as a ground of Justification for tho
second marriage; but, if upon investi
gation, it la clearly established that
tho first marriage, though legal and so
far honorable, was a marrlngo which
would not atnnd In her courtB, ns be
ing open antagonism to her lawH, then
that first marriage Is declared null
and void boforo her tribunals and a
subsequent mnrrlago may Do allowed
For example, under tho dlsclplino of
tho church, a mnrrlago contracted bo
foro tho civil authorities qr Protestant
pastors between a baptized Christian
of any douomlnation, and an unbnp
tlzud person, doea not hold good before
tno iniiunai oi uio cnuren, B-iwiiim-
ly tho partlea thcroto, If divorced, aro
freo, if not debarred by Bomo other
cuubo than tho dlvorco, to contract a
now marrlngo. In this and nil similar
caaoo, tho second marrlngo la permit
ted not on tho grounds of dlvorco, but
on tho ground of Invalidity or nullity
of tho first marrlago, as Judged by tho
disciplinary loglalatlon of tho Catho
lic church. This Is not casting a stig
ma on a marrlago, which tho church
rocognlzoa nB good and truo In law,
although lacking tho character of por
manoncy according to tho Inws of tho
church. In fact, nowadays, thoro
soonia to bo a growing tondoncy to
rocognlzo marrlngo aa almply legal and
binding only flo long aa tho law allows.
Tho porploxlty of bo many people,
upon discovering that dlvorcod por
boiib aro somotlmoB married In the
church, would bo much loss if thoy
boro In mind that under tho church
dlsclplino thoro aro altoguthor eight
or ton conditions, or no thoy aro tech
nically called ImpedlmontsT-.vhlch bar
marrlago, unloss thoso Impodlmonta
are, for good roaBons, romovod by
formor dispensation. Tho marrlago bo

depriving ono of tho contracting par
tloa of tho liberty ossontlal to nil con
tracts; BOlotnn rollgloua vowb also con
stitute ono of tho Impodlmonta. Closo
relationship Is n fourth.
Thoro Is a prevailing Idea that dis
pensations aro grantod by tho church
In consideration of social influence, or
what la worao, monoy powor. This
notion la absolutely false. It arlsas
from tho circumstances that a dispen
sation which la somotlmoa given in
high life la discussed by tho papors.
It Is frequently glvon to portions In
humblu Htntloim. Such a dispensation
la glvon by tho lncnl authorities. It
Is given horo without tho oxponse of
oiuv cent to tho applicants, whothor
rich or poor. It Is only In tho most
extraordinary and complicated casoe
that application for dispensation has

Made Daring Leap for Life.
A most daring and sensational leap
for llfo was mado last Saturday morn -
Ing hy Henry Moore, a track Inspector
on tno a. l'. co.'b line nt a trostlo
which spans Stony creek just north of

run ovor this division each morning

aa a result, came nonr mooting on tho
