The question of granting dermis
Blon for the placing of shlnglo roofs
upon buildings within tho firo limit
of the city precipitated a lively dis
cussion ut the rogular mooting of the
council Tuesday evening.
Shingle Roofs Not Wanted.
Application of J. A. Simpson and
K. S. Lamport for permission to place
a shingle roof on tholr proposed liv
ery Htable, to bo orocted on High
street, west of tho Court house, was
discussed at length, and finally re
ferred to tho committee on streets and
public property, with instructions to
report to the council at noxt regular
meeting.
Tho councir was petitioned by
Messrs. Lamport and Simpson and 23
other 'taxpayers to grant the applica
tion, but the protest that had boon
filed by tho mombers of Chemoheta
Lodge, No. 1, I. O. O. F won out, and
tho members of the council, aftor con
siderable discussion, refused to grant
tho prayer of tho petitioners at this
time. John .A. Carson appeared for
tho petitioners, and addressed the
council, soliciting favorablo action.
Stolz-moved that petition bo granted
and, in order Uiat tho question might
bo inado dobatablc, Qrlswold second
ed the motion, and Uion tho troublo
began. Qriswold Epoko In opposition
to tho petition, and Bald tho materials
to bo used in construction of roofs
within tho firo limits was provided
for In an ordinance previously passed
by Uie council. Ho was opposed to
tho substitution of combustible mater
ials for roof purposes in tho business
district of the city. Burrows thought
petitioners wore untitled to some con
sideration, and Stolz gave his opinion
acquired from personal uxporience, to
tho effect that properly treated shing
le roofing was not as dangorous in
caso of firo as was Corrugated Iron.
Pohlo nnd Wnlkor wore .non-conimlt-tnl
on tho subject. Mr. Carson again
addressed tho council upon the mat
tor undor consideration, and spoke
rnthor warmly upon tho apparent in
disposition of that' body to tako any
action at all on tho poUtloa that had

About the Fire Department.
The committee on llre nnd water
reported verbally, recommending that
the city's fire apparatus be coullued, to
the city limits. Adopted. The same
committee reported favorably upon
the keeping of both engines in the
lire department heated all of the time,
but the report was not favorably act
ed upon. At the sugetlou of Oris
wold the olllcers of the department
were Instructed to provide for the
transfer of the heating apparatus from
one lire engine to the other, so that
when the engine that Is regularly em
ployed - is called out, the reserve en
glue may be placed in readiness for
action, lu case of an emergency.
W. K. DeLong was npolnted chief
engineer, to have charge of the city's
tire department, during the month's
absence from the city of Mr. Camp
hell.
Sewer Remonstrance.
A remonstrance to the construction
of a sewer lu block SS was received
from Mrs. S. A. Itamp et nl., for the
alleged reason that the ditch was not
neoaweary. Referred to the commit'
tee on street and public property.
Alley Ordinance Pasted.
A general ordinance providing for
the cleaning, repairing and grading
khU graveling of alleys at the expense
of the abutting property, or at the
general expense of the city, was read
third time and paeeetl unanimously.
Unpaid assessments become a lien on
the property serred, and at the .expi
ration of six months, unlet paid, will
carry a penalty of 10 per cet.

To Raise Salary.
Qriswold moved that Ujo salary of
tho stroot commissioner bo raised from
$40 to f 60 per month, and that tho city
esact of that officer moro work than
was now being performed in that de
partment City Recorder Judoh in
formed tho council that In making the
levy for tho city's incomes for tho
year 1902, tho salary of tho street
commissioner was figured at $40 per
month, and any increaso in tho salary
of that official now would require an
amondmont to that ordinance. Furth
er consideration of tho proposed salary
Increaso was abandoned.
Miscellaneous.
Upon petition of W. A. Mooros and
15 others, tho street commissioner
wns instructed to clean up all debris
and place in lmmediato repair tho
sidewalk on tho north side of Loallo
street, between Twelfth and Capitol
streets.
The street commissioners woro also
directed to notify tho contractors who
aro erecting buildings on Stato street
that a passageway for pedestrians
must bo maintained on that sldo of
tho street, as was agreed upon whon
the city accorded to tho builders tho
use of the sidewalk and a part of the
street during tho building operations.

court, at lluffalo has orderod a perma
nent Injunction, with costs, and a full
accounting of sales, to issue against
Paul Ii. Hudson, manufacturer of tho
foot powder called "Dr Clark's Foot
Powder," and also against a retail
dealer of Brooklyn, restraining them
from making or soiling Dr. Clark's
Foot Powder, which Is declared, in
the decision of the court, an Imitation
and Infringement of "FOOT-EASE,"
the powder to shake Into your shoes,
now so largely advertised and sold all
over the country. Allon S. Olmstod,
of I.o Roy, N. Y Is tho owner of the
trade-mark "FOOT-BASK," and ho is
the first individual who evor adver
tised a foot powder oxtonslvoly ovor
the country. Tho doclslon In this caso
upholds his trade-mark, and render all
parties liable who fraudulently at
tempt to profit by tho extensive
"FOOT-EASB" advertising, in placing
upon the market a spurious and simi
lar appearing preparation, labeled and
put up in envelopes and boxes like
FOOT-BASK. Similar suits will bo
brought against others who are now
Infringing on the FOOT-EASE trade
mark and common law rights.
