Salem Flouring Mills Companies,
which, it is alleged, purchased from
Black 929! and 3977 bushels, rospoct

of tho estate, was begun to recovor
tho value of the grain. Appollato court
holds that the milling company can bo
hold llablo for the grain purchased
under such conditions, but remands
the case for a now trial, that all tho
depositors may bo made parties to the
suit, and that tho minor orrors may
bo correctod. The now trial Is al
lowed on condition Uiat plaintiffs pay
all costs. The principal depositors In
terested In the pending suit aro resi
dents of Polk and Linn countloa.
