Olaronro Venzio, defendant's attorney,
devoted considerable timo in attacking
the court's instructions to tho Jury, par
ticularly the instruction thnt only ono
of two verdicts could bo returned mur
der in the first degree or acquittal

sion of Dalton introduced in evidence
was inadmlesablo, became It was pro
cured by promises. Tt was also arguod

RiasBault on James B. Morrow, with
intent to tako his personal proporly.
Mr, Veazlo contended that thla is not
a statement ot tho facts constituting tlu
attempt to rob, as it does not eny what
was done. It does not say thoy put their
hands on him nnr describe what their
actions wero. Lio laid the jury should
have found two counts ; that tho defen
dant was attempting to commit robbery
and committed murder.
Tho answer of District Attorney
Chamberlain to the argument was
short. Ho said the toudoncy of tho
courts is to Instruct juries as in thli
caso, and it was done to prevent juries

He was being hauled up in a bucket

thon marched in tho direction of Presi

national hymn was sung.

hero today during the proceedings in the
case of the People vs. Drown, otherwise
known as tho Lookout lynching caso.
Considerable feeling has bcon exhibited
by both sides over since tho caeo camo
up for hearing a week ago. Today At
tornoy Harris, for tho dofenso, was en-
doavoring to break down tho testimony
of Agnea Wilson, a witnota for tho prose
cation, when the court objected to tho
lino of questioning, saying :
"Thoro will bo no such conduct In this
court wlti'e I am on tho bench,"
"Well, you won't bo thoro long," ro
torted Attorney Harris.
"I will be hero until my term is up,"
replied the court, "unless somoofyou
assassinate or shoot mo from behind."
At this point Attorney Baker, of conn
sol for the defense, remarked: "Well,
that's a ulco remark for a man to mnko
on tho bench. There is no man hero that
wants to assasdinato you."
"I can prove by a dozon witnesses
that Cnurtwright (a previous witness)
said that hi camo down from tho stand
to kill me, and he would have done so
had tho sheriff not interfered," replied
the Judgo.
