gravity of the offense. The same act,
therefore, committed by a rich man, will
bring on him tho necessity of paying n
sum which occasions him no Inconven
ience and committed by a jioor man, will
bring on him the necessity of paying a
sum which he has probably not got and
cannot obtain without bringing upon
others who are innocent, serious loss and
discomfort.
Most offenses nro committed by the
poor. If lined they nro unable to pay
tho flno nnd aro sent to jail for this do-
fault. Where the prescribed penalty Is
either fine or Imprisonment the latter is
generally indicted upon them. And what
does n Jail sontenco mean? To most a
more comfortable homo and better food
than thoy can get anywhere elso. It was
not so in tho early days of this century,
hero or anywhere. Throughout tho world
H3tty offenders woro nnd always have
been subjected to bo mo kind trf brief
bodily pain or discomfort and then re
leased. Every jail was n place of real
suffering and privation.
Tho truth is that modem society, at
least in tho United States, has largely
lost sight of tho rights of tho State as
against tho criminal in humanely en
deavoring to vindicate his rights as
against the Stnto.
Both have rights,but when they may
seem to coino in conflict they should
not, and rightly cannot, for tho welfare

punishment.
Such n return to ancient ways, or
rattier to the principlo of thone ways,
for tliat principle was often abused,
would not only help to prevent crime; it
would save an immense amount of pub
lic monoy. Every criminal in jail prob
ably costs, in ono way or another, no
less than $10 a week to tho taxpayors.
I had rather spend it in somo other
way.
