Alfred Ilolman, of tho Orogonlau
shows up tho closing record made by
the retiring secretary of state II. It.
Klncald as follow,:
"Yesterday It was reported that
shortly before rotlrlng from otlice tho
ox-secretary paid himself 890 from
the stato treasury on account of an
alleged subscription to the Eugene
Journal his own paper covering the
period from 1801 to October 25, 1808.
I went tills morning to tho office of
the secretary of state, and asked if
there was a record of any such trans
action. After a lutlo search It was
found, and I glvoherewlch a copy of
tbe voucher as sworn to and recclpte
(Then follows an itemized bill for
Klncald'a paper for 35 years and re
ceipted for as follows):
Received from n. R. Kliicatd, sec

payment of tho abovo account.
II. R, KlNOAlD.
"Accompanying this voucher and

opinion upon your legal right to draw
n warrant, In oavment of tbe samo. is
before me. There Is but one legal!
proposition to be considered, viz: lias
this claim or any yart thereor been
barred by the statute of limitation?
There can be no question In my mind,
as the account runs from year to year,
that the portion accruing for six
years Immediately prececdlng Its pre
sentation would be barred, but thore
Isaraexlm coequal with the law In
age and accuracy to the effect that
the statute of limitation never bars
against an honest man; neither will I
Invoke It. nor penult the state to do
so, If within my power, when this Is
the only technical dclensethat can bo

"The attornoy-gcncral's letter pro
ceeds In somo lines of further glittery
ing claptrap about "moral rcspousl-,
bllltyof tho stato" and tho "con-'
science of tho Individual," and ends
with a reputation of tho assuranco
that tho dofonso of the statute of

Interposed." Upon tho basis or this
letter, which in so many direct Words
declares all that part of tho claim ao-
curing prior to six years borore pre
