At noon today the supremo court
heard arguments or counsel In the
matter of appeal from Jackson county
In the motion for a new trial in the
case of State of Oregon vs. Frank L.
Smith, under sentence or death for
murdor of Peter Nelson, April 5, 1898.
O. B. Watson, Jprcseut prosecuting
attorney, (appeared for 'O, II. Dal
rymple, attorney for nppcllant Smith,
and Attorney General C, M, Idleman
and John A. Jeffrey, of Bonham,
Jeffrey and Martin appealed for the
state. Smith was Indicted, prose
cuted and convicted by Mr. Jeffroy,
who was then district attorney.
Tt seems several Indictments were
found as Smith had several aliases,
and they were worded In a different
manner for tho same crime, All but
the right one were dismissed.
In the argument counsel for ap
pellant raised tho single point that
the names of Emil Klrchgcssner and
J. B. Walt appear as witnesses on the
Orst Indictment and not on the last
one, and that the last ono ought
therefore to haye been dismissed by
tho court below. Tho only hypothesis
upon which this claim could havo any
foundation Is that all of these Indict
mentsaroone and the same, and such
a contention was denied by Jeffroy
as utterly untenable. An Inspection
of the record shows that the tirst In
dictment was for murder In the lirst
degree simple. It shows that tho
second was for murder committed In
the attempt to commit robbery; and
It also shows that the Indictment
upon which the defcudaut was tried
was for murder committed while en
gaged In the commission of a robbery,
