trict Attorney Hayden for prosecu
tion. Kalri he hnd made an exami
nation of the wounds on deceased;
that in his opinion he was dead before
he was thrown into the water: that
the deceased had come to his death
from the wounds on his head which
had been produced by some blunt
Instrument: that his skull was not
broken, that tho wound on his neck
was from 2 nnd J to 5 Inches deep;
that it had severed the common car-
otcd artery; the testimony now being
all taken the argument was pro
ceeded with. Mr. Slbly, Deputy
Prosecuting Attorney for Polk
County, opened the argu
ment for the state, In a short but
pointed argument. He reviewed brlclly
the evidence Introduced, nnd was
followed by Hon. W. H. Holmes, on
behalf of the defendant, who made n
very nblo plea In defense of his client.
District Attorney Hayden then
closed the argument for the state. He
mnde an Impassioned appeal and
asked that the defendant be com
mitted, At the conclusion of the argument
the magistrate bound the defendant
oyer to appear before tho grand Jury
which convenes at the olty of Dallas
