the case of H. L. Ward, rx-cotmty
treasurer, on trlul for the defalcation
of $12,000, reported a disagreement,
and was discharged by tho court S. t
urday. Ward was Indicted In .September
and the t.ial of the case commenced
lit Monday. Among the evidence
Introduced was a rnnilnirc given by
Ward, which states that It Is "for the
purpose of reimbuising his olllclul
bondsmen for his defalcation," and
which admits the 812,000 was con
verted by him as such trcisure
Ward throws the blame on his Uusl
nss partner, W. G. Howell, who
acted as his deputy, and attended to
the county treasurer's business,
drawing checks, etc. He says he took
$500 himself, before the three years
fixed by the statue of limitation,
forced by a settlement with a defunct
bank, tli.it lie learned of other
amounts short from howcll.
In charging the jury, tho court In
structed them that the statute of Urn
ltatlon must be observed, but that If
they found Ward had taken any sum
from 10 cents to $12,000, during the
three years, or had knowledge of his
partner so doing, It would constitute
ground for conviction.
Thocaso went to the jury at 10
o'clock Friday. Lite at r.lght It was
stated tho Jury stool 7 to 5 on the first
ballot for conviction. In the-morning
the Jury asked for furthur Instruc
tions, and were brought Into court.
Tho foreman said that all but two
had agreed, and they wanted furthur
Instructions. Jurymen Gosslin said
there was but one man standing out.
John Vollincr, a German, who did
not thoroughly understand the case
through his ignorance of English, and
asked that he be instructed In German.
Volmer rose, and explained why he
was for conviction, and tho court
uild ho needed no further instruc
tions. Gosslin said the Jury was sat
isfied thu county had sustained a loss,
but could not fix the amount taken
by Ward. Tho court sent them back
to tho Jury room to llguer It out. At
1 o'clock the Jury reported that they
could not agree, were called into
coait, and discharged. Ward and
Howell were given until Wednesday
to lllo new bonds, and Ward's case
was set for retrial six days alter
Howell's trial, at tho Feb.iuary term.
